미연방대법원 적극적 평등실현조치 판례 경향의 분석과 전망

초록

적극적 평등실현조치 내지 잠정적 우대조치(Affirmative Action)란 형식적인 평등을 가장한 불평등을 개선하기 위한 방안 중 하나로, 실질적 평등을 달성하기 위해 잠정적으로나마 차별적인 대우를 허용하는 정책 일반을 의미한다. 본 논문은 이와 같은 적극적 평등실현조치와 관련하여 미국 연방대법원, 그중에서도 고등교육기관의 입시와 관련한 판례의 동향 분석에 그 목적이 있다. 미국을 연구 대상으로 선정한 이유는 우선 미국이 1961년 케네디 대통령의 행정명령 10925호 이래로 가장 활발하게 적극적 평등실현조치를 실행해온 나라 중 하나라는 점 때문이며, 더 나아가 고등교육기관 관련 일련의 판결들은 그 안에서도 찬반 논의가 가장 활발히 이루어졌기 때문이 다. 미국의 적극적 평등실현정책에 대한 연구는 국내에서도 이미 상당 부분 이루어져 있고 관련된 주요 판례들 또한 여러 번 소개된 바 있다. 그럼에도 불구하고 이를 다시 살펴보고자 하는 이유는 판례에 대한 분석에 더해 해당 판결들에 결정적인 영향을 끼친 개별 재판관에 대하여도 살펴보는 것을 통하여 향후 우리나라에서 적극적 평등실 현조치가 본격적으로 쟁점화 될 경우 어떠한 부분을 참조하고, 또 어떠한 부분을 경계해야 할지 탐색해보기 위한 것이다.

Abstract

Affirmative action is a type of policy which tries to improve inequal status among social constituents under the guise of formal equality, by permitting, at least temporarily, discriminatory treatment in order to achieve substantive equality. The purpose of this thesis is to analyze legal precedents from the U.S. Supreme Court regarding affirmative action applied to institutions of higher education. The reason why the United States was selected for the study is because the US has been actively implementing a ffir mative action policies since President Kennedy’s Executive Order 10925 in 1961, in order to alleviate the social injustice of racial inequality that runs deep within the American history. Thus, the pros and cons of such policy have been discussed actively among the law yers over the years, and therefore provides a useful guideline for similar discussions within the Korean society. Research on US affirmative action policy has been conducted several times before in Korea. Nevertheless, the reason for reviewing the agenda once more is not because of total lack of previous studies, but rather to promote a broader understanding of equal rights under the law by taking a different approach. Simultaneously, with the analysis of such precedents, the study focuses on the individual justices who played a crucial role in formulating the majority opinion of the US Supreme Court, explaining how it led to the current conclusion on affirmative actions within institutions of higher education.
