본 연구는 1910년대 조선총독부가 고위 사법 관료를 해외로 파견하여 구미 열강의 식민지 사법제도를 조사한 배경과 그 내용을 분석하였다. 대한제국 강점 직후, 초대 총독 데라우치 마사타케는 헌병경찰을 앞세운 강압적이고 획일적인 무단 통치 체제를 구축하였다. 이러한 통치 체제는 한국인뿐 아니라 재조일본인과 일본 정치권에서도 비판을 받았다. 이에 조선총독부는 고위 사법 관료를 영국과 프랑스를 중심으로 한 구미 제국주의 국가에 파견하여 식민지 사법제도의 실태를 직접 조사하게 하였다. 조선총독부는 이들 관료가 조사한 구미 열강 식민지의 강압적이고 차별적인 사법제도를 바탕으로 식민지 한국에서 시행되던 헌병경찰 중심의 강력한 사법 통제 체제를 정당화하는 토대를 마련하고자 하였다. 1910년대 조선총독부 사법 관료의 구미 식민지 사법제도 조사는 조선총독부 통치 체제의 정당성 확보를 위한 국제적 비교 전략인 동시에, 식민지 한국에 대한‘효과적인’사법적 지배체제를 구조화하는 의도로 추진되었다.
Abstract
This study analyzed the background and significance of the investigation into the colonial judicial systems of Western imperialist countries by the Chosen Government General[朝鮮總督府] in the 1910s. Immediately after the occupation of the Korean Empire[大韓帝國], the first Governor-General Terauchi Masatake[寺内正毅] established a coercive and uniform military rule system led by the military police. This ruling system was criticized not only by Koreans but also by Japanese living in Korea and by Japanese politicians. Accordingly, Chosen Government General dispatched high-ranking judicial officials to Western imperialist countries, centered around UK and France, to directly investigate the reality of the colonial judicial system. Chosen Government General attempted to justify the strong judicial control system centered on the military police in colonial Korea based on the oppressive and discriminatory judicial systems implemented in the colonies of Western imperialist countries that these officials investigated. These investigations of the colonial judicial systems of Western imperialist countries by Chosen Government General judicial officials in the 1910s was an international comparative strategy to secure the legitimacy of the colonial ruling system. Moreover, these investigations were pursued with the intention of structuring a judicial system of governance over colonial Korea.
