Abstract
Around 1920, socialist ideology[社會主義] began to exert significant influence on Korea’s nationalist movement. In response, the Government -General of Korea[朝鮮總督府] enforced Japan’s Peace Preservation Law[治 安維持法] within the colony and established a dedicated department with appointed prosecutors to handle so-called ideological crimes[思想犯], while also conducting judicial research on socialist movements. At the same time, colonial authorities dispatched judicial officials to Western countries to examine laws and policies related to the control of socialism. Particular attention was given to Germany’s Law for the Protection of the Republic [Gesetz zum Schutze der Republik], which served as a model for the Peace Preservation Law. This German law not only permitted the death penalty for acts threatening the state and targeting government personnel but also allowed for combined punishments such as imprisonment and unlimited fines. It expanded the scope of criminalization to include not only direct acts like murder and assault but also verbal offenses such as defamation of government officials. Punishment extended not only to direct perpetrators but also to those who were indirectly involved. At the time, Korean public opinion emphasized economic stability and access to education as fundamental solutions to the intensifying ideological conflict. The judicial authorities of the Government-General also recognized, based on their observations of Western socialist control policies, that economic security could effectively suppress socialist movements. Nevertheless, following the outbreak of the Second Sino-Japanese War[中日戰爭], the colonial regime further strengthened its ideological control by introducing a probation system[保護觀察制度] and a preventive detention system[豫防 拘禁制度] for ideological offenders under the National Mobilization System [國家總動員體制]. Eventually, the Peace Preservation Law incorporated provisions resembling the extra-constitutional elements of the German law, enabling the authorities to regulate even the most trivial speech and behavior of Korean subjects.
