스페인과 한국의 형법상 명예훼손범죄에 대한 화용적 고찰

본 연구는 스페인과 한국에서 언어 범죄로 여겨지는 명예훼손죄에 관한 법률 조항과 최근 판례들에 대한 언어학적 분석을 시도한다. Hancher(1980)와 Tierma (1987)은 명예훼손을 Austin(1962)과 Searle(1976)의 화행이론에 기반을 두어 법학과 언어학을 잇는 학제 간 분석을 시도하였다. 구체적으로는 명예훼손 발언을 하나의 화행으로 규정하고 화행의 두 측면인 발화수반행위와 발화효과행위로 나누어 분석할 필요성을 제시하였다. 하지만 이와 같이 명예훼손죄를 언어학적으로 분석하려는 시도가 많지는 않은 가운데, 스페인에서는 Guillén Nieto(2020)가 한국에서는 이해윤(2018, 2020)이 명예훼손죄와 모욕죄 관련 자국의 형사법을 검토하고 판결 사례들을 언어학적으로 시도한 것이 유일한 실정이다. 본고에서는 양국의 명예훼손 관련 법률 조항들을 검토하고 대조언어학적 비교를 위하여 ‘명예훼손화행’에 대한 적정조건들을 제시하고 이를 통하여 최근 판례들에 대한 언어학적 분석을 시도한다. 본 연구에서는 ‘명예훼손’을 화행으로 간주할 경우, 그 본질상 화용론에서 말하는 발화효과를 예견할 수 있는 개념이기 때문에 이를 감안한 새로운 적정조건이 필요함을 지적하였다. 본 연구는 스페인과 한국의 명예훼손죄를 화용론적으로 비교 분석한 최초의 시도라는 점에서 학문적인 의의가 있으며, 아울러 국내 판례와 비교를 통해 두 국가 간 법률 적용 기준의 차이에 대한 언어학적 해석을 제공한다는 점에서 언어학 분야뿐만 아니라 법학 분야에도 실용적인 의의가 있다고 볼 수 있다.
Abstract
This study attempts a linguistic analysis of the legal provisions and recent precedents of defamation, which are considered crimes in Spain and South Korea. Hancher(1980) and Tierma(1987) attempted an interdisciplinary analysis linking Law and Linguistics based on Austin (1962) and Searle(1976)'s Speech Act Theory. In particular, they considered defamation as a speech act and argued that the defamatory speech act just like any other speech act would be subdivided into two aspects: its illocutionary act and its perlocutionary act. In intralinguistic perspectives, we can only mention a couple of studies: Guillén Nieto (2020) on the defamation law and the judicial precedents in Spain and Lee(2018, 2020) on the ones in South Korea. In the current paper, we have examined the concrete legal clauses related to defamation and a few of recent precedents in the two countries. The implication of this study is as follows. We have newly proposed felicity conditions for a defamatory speech act based on the legal definition of defamation in both countries. It is of academic significance that it is the first attempt to compare defamation crimes in Spain and South Korea under the pragmatic framework. Therefore, the findings would have some implications not only from the linguistic viewpoints but also from the legal ones.
