초록
In this paper, we will present the method of analyzing the cases of defamation, which is among language crimes. This work is the revision of Lee(2018). Based on the assumption that language crimes are related to speech acts, we try to explain the defamation by the combination of an illocutionary act and a perlocutionary act. In detail, we set up ‘accusing’ as an illocutionary act for the defamatory utterance and ‘insulting’ as a perlocutionary act. The former is checked by its felicity condition and the latter indirectly by the ‘impoliteness’ strategy of Culpeper(1996). In addition, it is assumed that the utterance in question must contain the concept of ‘social face’, i.e. fame. Our analysis of some cases will show that the linguistic explanation of cases is different from the legal explanation, even if the conclusion is the same, and that the former is more objective and more persuasive than the latter.
