Abstract

The application of the Security Act as a criminal law during the Japanese colonial rule of Korea from 1907 to 1919 is examined, focusing on its role in social control. While criminal law fundamentally aims to realize social justice and maintain legal stability, the Japanese colonial government appropriated it as an efficient tool of repression to sustain colonial domination. The Security Act comprised provisions restricting associations, assemblies, and political expression, alongside punitive measures against politically subversive activities. It was broadly applied to suppress ethnic religions, independence movements, and patriotic education. Notably, the Act was often applied cumulatively with other charges to intensify punishments. Through vague criteria, the Security Act criminalized a wide range of political dissent and enforced severe penalties, including flogging, imprisonment, and incarceration, thereby functioning as a central instrument of colonial governance. Consequently, the nature of criminal law during the Japanese colonial period was distorted from its original purpose of upholding social justice to serving as a political tool for maintaining colonial control.
