아동학대에 대한 경찰단계의 현장대응 강화를 위한 법, 제도 개선사항 연구

2015년 12월 말부터 연이어 발생한 끔찍한 아동학대 사건은 우리나라 사회에 큰 충격을 주고 있다. 아동학대에 대한 근본적 문제해결을 위해서는 학대 예방, 사례 발굴, 재발방지를 위한 모니터링 및 사후지원 등이 체계적으로 이뤄져야 하나, 무엇보다 신고 된 학대사건에 대한 신속하고도 전문적인 현장대응이 중요할 것이다. 이 연구는 2016년 6차례에 걸친 정부합동 전수조사 대응 과정에서 아동학대 신고사건에 대해 현장에 출동하고 수사, 사후관리 업무를 담당한 경찰의 대응현황과 그 과정에서 나타난 법과 제도의 문제점을 살펴보는데 있다. 이를 통해 현장 인력증원, 「아동학대범죄의 처벌 등에 관한 특례법」 보완, 다기관 협력체 구성, 공적CPS 도입 등을 제시하였다.
Abstract
Law enforcement officers are obligated to possess an adequate level of knowledge and skills regarding proper use of police deadly force in the line of duty. In that regard, police officers must be constantly trained regarding use of force from the beginning of their law enforcement career. Police officers in the Korean National Police Agency participate in marksmanship style police shooting drills at the distance of 15 meters with .38 caliber revolver of which barrel length is four inch long. However, the settings where police officers use deadly force in the field are totally different from the those of shooting drills. Despite the importance of police shooting drills, no empirical research study has been conducted regarding the disparity between police shooting drill programs and actual police shooting practices in field. To fill the gap in research, the current study, for the first time in Korea, attempted to analyze police use of deadly force reports since 2006 and conducted telephone interviews with police officers who filed the reports. The current study found that police use of deadly force incidents occur at various distances. Therefore, the police shooting drill program in the Korean Police Agency must be redesigned to include range shooting drills from the distance of 1 meter to 15 meters, marksmanship style shooting skill development as well as point shooting techniques.
