다문화 법교육의 가능성 탐색

각 교과 간 다문화교육이 경쟁적으로 벌어지고 있는 상황에서, 사회과 법교육 영역에서도 다문화 교육의 가능성을 탐색해 볼 필요가 있다. 이때 사회과 법교육 영역에서 다문화 교육과정의 구성은 기본적 인권, 인간의 존엄과 가치, 행복추구권 등을 중심으로 하는 헌법교육이 그 핵심이 되어야 할 것으로 보인다. 다문화교육에서 가장 큰 딜레마라 할 수 있는, 통합과 차이, 동화주의와 다문화주의의 균형을 찾기 위해서는 헌법에 나타난 기본적 인권 및 인류의 공감대적 가치를 중심으로 사회통합을 지향하면서, 개성의 자유로운 발현권 등 개별 기본권을 중심으로 ‘차이’를 인정하는 관용의 정신을 지향하도록 교육과정을 의도적으로 구성할 필요가 있다. 이주노동자를 비롯한 재한외국인들에 대한 인권보장과 결혼이민자 및 그들 가정의 사회통합을 중심으로 한국사회의 현실에 적합한 다문화 법교육이 추가적으로 연구되고, 구체적인 다문화 법 교육과정으로 구성될 수 있도록 해야 할 것이다.
Abstract
In the circumstance of the heavy competition between subjects for the multicultural education, the core of the multicultural education of law-related education(LRE) in social studies is the constitutional education including the fundamental human rights, the dignity of human beings, and the right to pursue one's happiness, etc. For the balance between 'unification' and 'differentiation' and that of 'assimilationism' and 'multi-culturalism', the multicultural education of law-related education(LRE) in social studies is composed of the curriculums that aims for social integration by means of the fundamental human rights and for tolerance by means of the right to show one´s individuality. The curriculum concerning the multicultural education of law-related education(LRE) in social studies, that is suitable for Korean society must be studied continuously and additionally, for the guarantee of the human rights of foreigners staying in Korea for many a long day and for social integration of migrants by marriage and their families.
