Abstract
This study analyzes the implications of using genetic testing to confirm family relationships as one of the supporting documents when Koreans who migrated to China before the establishment of the People’s Republic of China in 1949 and their descendants regain or naturalize South Korean citizenship. This study explored the logic of inclusion and exclusion of immigrants based on genetic factors in the Korean context, drawing upon biological citizenship as its theoretical background. Related laws, policies, case law, and news articles were analyzed through a literature review method. The results of the study showed that ‘Korean blood ties’ is one of the fundamental logics for including Korean ethnic and their descendants as members of the Republic of Korea. Other important criteria include the instrumentality arising from changes in political and economic relations and South Korea’s population issues, as well as the sacrifices and contributions of oneself or one’s ancestors to the Republic of Korea. The use of genetic testing to prove family relationships was coupled with jus sanguinis and served as supplementary data in order to confirm family blood ties. Biological factors played a key role in the acquisition of nationality, as it enabled the proof of family relationships through genetic testing. It was observed that the state recognized the sociocultural diversity of immigrant groups based on the premise of biological families. This study interpreted this as ‘adjusted diversity’ and critically discussed the issues regarding genetic factors.
