이 논문은 무국적자에게 시민권은 어떤 의미가 있는가에 대한 질문으로 시작한다. 연구자들은 ‘시민권’을 다양한 의미로 정의한다. 법학에서는 ‘정치적으로 조직화된 공동체에 소속된 지위와 그에 수반하는 권리와 의무의 총체’, 사회학에서는 법적 지위뿐만 아니라 ‘시민의식과 시민으로서의 덕성’과 ‘시민의 참여’를 포함한다고 설명한다. 이러한 정의들은 개인이 현재 거주하는 국가에 소속되어 있음을 전제로 하는 것이다. 한편 외국인의 시민권과 관련하여 ‘시민권은 국민의 배타적 권리를 의미하는 것에서 벗어나, 좀 더 넓은 의미에서 인간의 권리의 하나로 확장될 가능성’이 논의되기도 한다. 더 나아가 초국가적으로 작동하는 규범과 권리 시스템에 주목하여 ‘탈국가적 시민권’을 주장하기도 한다. 그렇다면 ‘확장된 의미의 시민권’은 국민국가의 시민권을 확보하지 못한 무국적자에게도 작동하는가? 무국적자는 시민권이 있는가? 한국 사회에서 무국적자는 시민권을 행사할 수 있는가? 이 논문은 이러한 질문에 대답하기 위한 논의를 제안하면서, 오늘날 무국적자의 국제적 정의와 지위를 재검토하고, 국내 무국적자의 통계와 유형을 포함하는 현황을 파악하면서 이들에 대한 한국의 법제도를 검토한다. 이를 통해 이 논문은 사회의 급격한 변화 속에서 법적·정치적·사회적으로 배제되는 인구를 최소화하기 위해서는 배타적 시민권 체제에서 포용적 시민권 체제로 바뀌어야 한다고 주장한다.
Abstract
This paper questions what citizenship means to a stateless person. ‘Citizenship’ is often defined with various meanings. Legal studies may limit its definition to ‘the totality of the status and rights and obligations associated with a politically organized community.’ Sociological approaches may include not only the legal status but also ‘civic consciousness and virtue as a citizen’ and ‘citizen’s participation.’ These definitions presuppose that an individual belongs to the country in which he or she currently resides. On the other hand, regarding the citizenship of foreigners, the possibility of ‘citizenship moving away from meaning the exclusive rights of the people and expanding into one of human rights in a broader sense’ is also discussed. Furthermore, some argue for ‘transnational citizenship’ by paying attention to norms and rights systems that operate transnational. If so, does ‘citizenship in an extended sense’ work even for stateless people who have not secured citizenship in the national state? Do stateless people have citizenship? Can stateless people exercise citizenship in Korean society? This paper proposes a discussion to answer these questions, reviewing the international definition and status of stateless people today. It also reviews the Korean legal system for them while grasping the current status including statistics and types of stateless people in Korea. Through this, this paper argues that in order to minimize the population who are legally, politically, and socially excluded amid rapid changes in society, it is necessary to change the exclusive citizenship system to an inclusive one.
