Abstract
In case where a child is born of non-Korean parents (and socialized) in South Korea, which adopted jus sanguinis, the child would not automatically acquire South Korean citizenship at birth under Article 2 of the Act of Nationality. This is opposite to the direction of jus soli where children born to short-term travelers gain citizenship. As an alternative between jus soli and jus sanguinis, this article examines the legislation on the supplementary birthplace principles in Germany and France, legislation that has existed as an exception to jus sanguinis, a rule of citizenship that restricts children born and raised in those countries from becoming citizens at birth. Despite the dualism between blood and birthplace, both jus soli and jus sanguinis principles share similarities in the sense that they may apply to citizenship being granted at birth. The absolute application of either principle however, leads to inequality between citizens, who do not have genuine link to a state, and a foreign national, who is able to establish a close bond as a community member. As this discrepancy between de jure citizen and de facto member may manifest as social conflict, it has become a global trend that jus soli and jus sanguinis policies must be modified to become less distinct than they have been in the past. This article introduces recent amendments to relevant laws, and compares legislative cases from Germany and France to analyze the possibility of adopting such principles in the Act of Nationality for social integration and access to citizenship for children born and raised in South Korea. On the basis of the models between two European countries, this article examines legislative goals or values, policy target groups, and requirements for citizenship acquisition. It also proposes an expected level of effectiveness and normative value for such legislative adoption in the current South Korean domestic context.
