Abstract
This article introduces an interesting discussion on David Lewis' distinction between convention and social contract, and attempts to apply his discussion concretely to Hume's account of the English constitutional history. The English constitutional history divides itself into three periods. The first period spans from the Magna Carta to the Tudor dynasty (lone disobedience > the status quo > state of nature), the second covers James I and Charles I of the Stuart dynasty and the Commonwealth period (state of nature > the status quo > lone disobedience), and the third stretches from the Restoration to the Glorious Revolution (from covert lone disobedience to its overt exercise). In this process, the author seeks to illuminate political dilemmas and the significance of political actions that cannot be fully interpreted through the lens of social contract. There have been obstacles to studying Hume’s English constitutional history. The greatest one is to find an analytic framework which divides a long period of time in a meaningful way. Lewis’ distinction between convention and social contract paves way to identifying political predicaments in the establishment of conventions for the English mixed government and providing an overall analytic framework for it.
