이 글은 흄의 자유에 대한 철학적 논의를 검토하면서 그의 『영국사』에서 법에 근거한 자유 헌정의 의미를 살펴본다. 흄의 철학적 자유 논의가 갖는 가장 큰 장점은 로크에서 발견할 수 없는 자유에 대한 새로운 통찰을 제공한다는 점이다. 이를 바탕으로 흄은 영국의 자유 헌정 수립에 감추어진 자유와 복종의 갈등을 깊이 꿰뚫어 본다. 『영국사』로부터 도출할 수 있는 좋은 시민에 대한 그의 결론은 한마디로 “법적 헌정에 대한 폭넓고 개명된 애정”을 가진 사람이다. 이 결론은 홉스의 개인이나 로크의 자유 논의에서 찾아볼 수 없는 것이다. 또한 이 결론은 자유 헌정에 대한 애정을 가졌던 휘그파와 영국 헌정에 대한 애정을 가졌던 토리파의 정서를 아우를 수 있는 것이라 생각된다. 동시에 흄의 역사 서술은 그들이 인간이기 때문에 빠지기 쉬운 편견과 편협성을 보게 하고 교정해 준다. 자유와 복종의 균형잡기를 통해 이룩한 위대한 정치적 성취를 앞에 두고 정파의 차이를 지나치게 강조하는 과오를 범하는 것은 어리석은 짓이다.
Abstract
This article examines Hume’s philosophical arguments of liberty & necessity, and elucidates the meaning of free constitution in his History of England. For Hume, liberty is not a concept of opposition to necessity, but to “violence.” This philosophical argument of liberty offers a new insight, which cannot be found in Lock’s Essay concerning Human Understanding. The insight enables us to see through the struggles between liberty and obedience in the English history. For Hume, the quality of good citizen is characterized as “an enlarged and enlightened affection towards a legal constitution.” This conclusion drawn from his History of England, which makes a big difference from those of his predecessors, Hobbes and Locke, embraces both the whig party’s affection for liberty and the tory party’s affection for obedience. At the same time, Hume’s historical descriptions disclose and correct their prejudices and bigotry which human nature apts to fall into. It is stupid to exaggerate the difference and distance between the two parties in front of the great political achievement through struggles for the balance of liberty and obedience. Acute struggles would make civil liberty disappear.
