사회적 관행 이론의 세 모델: 비판적 고찰

초록

관행은 일상적인 삶에서 뿐만 아니라 법적 영역에서도 중요한 의의를 갖는다. 그럼에도 불구하고 관행 그 자체에 대한 본격적인 법철학적 연구는 충분하지 못한 실정이다. 이러한 배경 하에, 이 글은 우선 기존의 사회적 관행 이론들의 전체 지형도를 조망하고 각 모델의 주요 내용을 살펴본 후 비판적으로 검토한다. 구체적으로는, (1)관행을 조정 문제에 대한 해법으로 정의하는 흄과 루이스를 중심으로 한 ‘조정 해법 모델’, (2)루이스의 기본 전제를 거부하며 등장한 대안적 접근들로 길버트, 밀러, 밀리칸의 ‘대항 모델’, 그리고 (3)루이스의 조정 관행을 수용하면서도 그 이론이 설명하지 못하는 새로운 관행 유형들을 제시함으로써 조정 관행 모델의 결함을 보완한 마머의 ‘복합적 관행 모델’이 있다. 세 모델은 각기 고유한 이론적 배경과 해결 과제를 바탕으로 관행의 개념과 본질을 규명하고 있지만, 일부 공통적인 한계도 발견된다. 필자는 기존의 이론들은 사회적 관행에 대한 일반 이론의 차원에서도, 그리고 법이론의 차원에서도 결함이 있음을 지적한다. 나아가 궁극적으로는 관행의 동적 측면과 법이라는 담론 영역의 특수성을 반영한 대안 이론 모델 개발이 필요함을 주장한다. 대안적인 ‘법학적 관행 이론’은 사회적 관행에 대한 일반 이론 차원에서의 개선일 뿐 아니라, ‘법이론으로서’의 특수한 과제도 수행할 수 있어야 한다. 본고에서 탐구한 기존의 사회적 관행 이론의 세 모델에 대한 충실한 분석과 비판적 검토는 대안적인 관행 이론 모델 개발을 위한 중요한 이론적 기초를 제공할 것이다.

Abstract

As well as in our daily life, conventions play a significant role in the specific context of legal discourse, in the light of which serious inquiry into convention per se cannot be said to have been sufficiently done in the field of legal philosophy. With this in mind, this article first overviews and critically examines the three major theoretical models that has been advanced on social convention: (a) ‘Coordination Solution Model’ by Hume and Lewis, which defines conventions as a solution to the coordination problem; (b) ‘Alternative Model’ by Gilbert, Miller, Millikan, which is based on a denial of Lewis’ fundamental premises; and (c) ‘Multi-Layered Alternative Convention Model’ by Marmor, which basically accepts the ‘coordination convention’ concept but provides a new perspective on the concept of convention itself to overcome limitation of Lewis’ theory. Though the above models explain the concept and nature of convention with different theoretical backgrounds and with respective merits, they are found to have some limitations in common: (i) as general theory on social conventions, and (ii) as ‘legal’ theory. Accordingly, the author stresses the necessity to establish a new model defining the concept of ‘legal convention’, acknowledging the dynamic character of conventions (‘dynamic approach’) and the peculiarity of ‘legal’ discourse. The new ‘Legal Convention Theory’ should also be able to elucidate the normative features of genuine social conventions in depth. The critical study in this article on the above existing models seeks to provide a theoretical foundation for the actual development of the new convention theory.
