본 고는 홉스와 로크, 루소의 고전적 사회계약론에 대한 검토를 바탕으로 이들 이론의 시사점과 한계에 대해 살펴본다. 고전적 사회계약론은 논리 전개 방식과 구체적인 내용에서는 각각 차이가 있지만, 자유롭고 평등한 개인이 자연 상태의 어려움을 극복하기 위한 목적에서 구성원 상호 간에 계약을 맺어 공통의 주권 권력을 설립하고 그러한 권력에 복종함으로써 평화와 안전을 획득한다는 핵심 내용에서는 공통된다. 홉스, 로크, 루소의 고전적 사회계약론은 비록 각 이론 내부적으로는 일정한 한계를 드러내고 있음에도 불구하고, 정치 제도와 국가의 정당성의 기반을 평가할 수 있는 견고한 사상적 토대를 마련함으로써 자유롭고 평등한 개인의 권리의 우선성을 확보하고 근대 민주주의 이론의 발전에 기여하였다.
Abstract
This paper undertakes an exploration of the classical social contract theories proposed by Hobbes, Locke, and Rousseau. Through an examination of their theories, it seeks to uncover the implications and limitations inherent within them. While these theories display variations in terms of logical development and specific content, they converge on a central premise: the idea that free and equal individuals, for the purpose of overcoming the challenges of the state of nature, enter into contracts voluntarily. These agreements establish a common sovereign authority, which, through obedience, ensures the attainment of peace and security. Despite some internal limitations within each theory, the classical social contract theories of Hobbes, Locke, and Rousseau have provided a robust conceptual foundation for evaluating the legitimacy of political institutions and the state, thereby securing the primacy of the rights of free and equal individuals and contributing to the development of modern democratic theory.
