최근 스마트폰, 태블릿PC 등 스마트 기기가 대중화됨에 따라서, 공공데이터를 활용해 새로운 서비스와 상품 개발을 위한 민간의 공공데이터 활용수요가 폭발적으로 증가하고 있다. 그러나 실제 민간이 활용할 수 있는 공공데이터는 턱없이 부족한 실정이다. 이는 공공데이터의 민간제공과 이용을 체계적으로 뒷받침할 수 있는 법률적 근거가 없어 국가차원의 적극적인 대응이 현실적으로 어렵기 때문이다. 본 논문은 공공데이터의 개방에 따른 경제적 효과 분석과 함께, 『공공데이터의 제공 및 이용 활성화에 관한 법률』의 구성과 내용을 설명하여 향후 『공공데이터의 제공 및 이용 활성화에 관한 법률』 제정을 통해 해결할 수 있는 주요 현안을 살펴보고자 한다.
Abstract
Along with the recent popularization of smart devices such as smart phones and tablet PCs, the demand for the opening of public sector data to the private sector for developing new services and products utilizing public sector data has been increasing explosively; however, the public sector data actually available for the private sector is unreasonably lacking. This is because there is no legal basis that may support systematically the offering of public sector data to and use of public sector data by the private sector; therefore, it is difficult to cope actively with this at a national level. This paper is to review the main issues that may be solved through legislation of the “Act on the Promotion of the Offering and Use of Public Sector Data” in the future by explaining the composition and contents of the “Act on the Promotion of the Offering and Use of Public Sector Data” along with an analysis of any economic effects from the opening of public sector data.
