초록

지능정보사회로 진입하면서 인공지능 등 신기술의 핵심 기반이 되는 데이터는 기업 경쟁력뿐만 아니라 국가 전반을 혁신할 수 있는 국가 경쟁력의 주요 수단으로 작용하고 있다. 특히, 방대한 양의 데이터가 축적되고 있는 공공 부문 데이터는 활용에 있어 무한한 잠재성을 가지고 있으나 법적 한계가 존재하여 이와 관련한 개선이 필요하다. 대표적으로 현행법상 공공 부문 데이터에 대한 상이한 개념 정의로 인하여 기준 데이터 개념의 부재 문제는 공공 부문 데이터 활용 활성화의 주요한 저해 요인으로 작용하고 있다. 이처럼 국내 법제상 공공 부문 데이터 활용 활성화를 저해시키는 다양한 법적 한계를 도출하고 이에 대한 법제 개선 방안을 도출하는 것이 중요할 것으로 사료된다. 본 고에서는 공공 부문 데이터의 체계적이고 범국가적인 활용 활성화를 위하여 공공 부문 데이터 개념과 관련하여 국제적 논의와 국내 법제상 개념을 살펴보고 공공 부문 데이터 활용의 근본이념과 의의를 살펴보았다. 그리고 공공 부문 데이터 활용과 관련한 현행법상 한계와 해외 입법례의 비교를 통하여 현행법상 개선방안과 데이터 기본법 제정을 통한 개선방안을 중심으로 법제 개선방안을 모색하였다.

Abstract

As we enter the intelligent information society, data, which is the core foundation of new technologies such as artificial intelligence, is acting as a major means of national competitiveness that can innovate not only corporate competitiveness but also the entire country. In particular, public sector information, in which a vast amount of data is accumulated, has infinite potential for utilization, but there are legal and institutional limitations and improvement is needed in this regard. The absence of a standard data concept due to different definitions of public sector information under the current law is a major impediment to the vitalization of public sector information utilization. As such, it is considered important to derive various legal limitations that hinder the activation of information utilization in the public sector in the domestic legal system and to draw up measures to improve the legal system. In this reseach, to promote the systematic and national utilization of public sector information, international discussions and domestic legal concepts related to the public sector information concept were reviewed, and the fundamental philosophy and significance of public sector information utilization were examined. In conclusion, by comparing the limitations of the current law related to the use of information in the public sector and overseas legislative examples, the method for improving the legal system was sought.
