형정(刑政)에 관한 정조(正祖)의 인식과 이해는 『서경』의 형(刑) 개념에 기반하고 있다. 『서경』에서 제시되는 형정 개념은, 국가통치에서 덕치와 예치가 주 역할을 담당하고 형정은 보조적인 역할을 하는 유가 예치의 법사상의 원형을 제시한다. 『서경』에서 형 개념은 법 집행자의 입장에서 법을 신중하게 적용할 것을 주문하는 흠휼(欽恤), 권형(權衡), 호생지덕(好生之德)과, 형정의 역할과 효과의 측면에서 교화의 의미를 강조하는 형기무형(刑期無刑)과 상형(祥刑)으로 제시할 수 있다. 정조는 재판의 판결과 집행 및 형정 관련 법제서 편찬 등 직접적으로 형정을 수행하였으며, 이때 형의 적용에 있어 중요하게 여겼던 가치들이 『서경』에서 비롯되었다. 『경사강의』 「상서강의」를 통해 『서경』에 대해 직접적으로 논의하고 있으며, 형정의 현실 적용을 고려하여 경문을 입체적이고 비판적으로 해석하는 것이 그 특징이다. 흠휼의 가치를 실현하는 데 현실적인가를 기준으로 하여 『서경집전』의 채침(蔡沈) 주석 및 경문에 대해서 비판적으로 해석하였다. 또한 형정을 예치를 보완하는 보조적 역할로만 인식하는 것이 아니라, 현실 정치에서 주요한 역할을 함을 긍정하였다. 정조는 『서경』에서 제시된 흠휼과 무형 등의 이념을 실제 형정에서 실현하고자 하였다. 형정 관련 법제서를 편찬하며 형 집행의 기본 정신을 『서경』에서 근거한 ‘신중함’으로 제시하였으며, 재판을 신속하고 신중하게 판결하여 흠휼과 호생지덕을 실현하고자 하였다.
Abstract
King Chŏngjo’s recognition and understanding of the administration of punishment(刑政) are based on the concept of punishment(刑) in The Book of Documents(書經). The concept of the administration of punishment in The Book of Documents shows the prototype of Confucianism, in which virtue and ritual play the main role in national governance; and the administration of punishment a secondary role. In The Book of Documents, the concept of punishment can be presented as the guiding of conduct(刑期無刑) and capital punishment(祥刑) emphasizing the meaning of edification in terms of the role and effect of punishment, as well as the virtues of compassion(欽恤), balancing(權衡) and mutual benefit(好生之德) which order the careful application of the law to enforcement officers. King Chŏngjo directly carried out the administration and politics of punishment, such as making judgments and executions of trials and compiling legal documents. At this time, he kept in mind the values that originated from The Book of Documents. He directly discussed in The Book of Documents through the Gyeongsa Gangui(經史講義) and “Sangseo Gangui(尙書講義)”, and was intended to realize the idea of compassion and the guiding of conduct in The Book of Documents. He critically interpreted both the original text of The Book of Documents and the annotation of Cai Shen(蔡沈) based on whether the idea of compassion is realized. In addition, he not only recognized the administration of punishment as a secondary role but also affirmed that it plays a major role in real politics. He compiled legislation related to the administration of punishment, and presented the basic spirit of punishment as ‘cautious’ based on The Book of Documents, and tried to realize the virtue of compassion and mutual benefit by making judgments quickly and carefully.
