Abstract
This paper analyzes the judgments recorded in Simnirok to examine how Jeong (情) was considered in Jeongjo’s legal reasoning and what philosophical implications it carries. Rather than applying positive law mechanically, Jeongjo sought to realize justice by closely considering the factual circumstances of cases and the emotional states of the parties involved. His judgments reflected a dual structure of emotional consideration: the acknowledgment of concrete situational contexts (實情) and the assessment of socially acceptable emotions based on Confucian moral sensibilities (情緖). These considerations included factors such as intent, principal versus accomplice distinctions, witness credibility, ambiguity of cause of death, ethical legitimacy of motives, and sincerity of remorse. While such reasoning embodied the Confucian ideal of eliminating unjust suffering (無冤), it also raised concerns regarding the codification of emotional norms, the legitimization of private punishment, the marginalization of victims, and the potential arbitrariness of judgment. By analyzing the tensions in Confucian legal governance, this study explores the philosophical significance of integrating emotion into legal reasoning and suggests a possible framework for institutionalizing emotional consideration within legal systems.
