본 연구는 서구식 제도의 시각에서 운영되고 있는 우리나라 형벌제도의 목적과 운영상에서 노정되는 문제점에 대한 해결책을 모색하기 위해 역사학적 관점에서 조선시대의 형벌제도를 통해 그 해결책을 모색하는 것을 목적으로 하고 있다. 조선왕조는 통치철학을 유교이념에 기초했기 때문에 형벌 또한 ‘도덕적 교화’이라는 유교적 형벌목적을 가졌다. 조선왕조는 유교적 사회질서를 해치는 범죄에 대해서는 강력하게 형벌을 집행했지만, 기본적으로 예를 법의 우위에 두어 백성들이 유교적인 질서 하에서 평화로운 공동체생활을 영위하도록 했다. 이를 위해 조선왕조는 죄형법정주의와 정형주의를 완성했고, 특히 형벌제도를 법률로 명확히 하여 형벌집행의 남용을 방지했다. 또한 백성의 신체와 생명을 보호에 만전을 기하는 흠휼정책을 적극적으로 실천하였다. 이와 같이 조선왕조의 형벌제도가 동해보복적 응보형 위주가 아니라 백성의 생명과 신체를 중히 여기는 유교적 인본주의 사상이 제도를 통해 구체화되었다는 점은 매우 의미가 있다. 오늘날 우리의 형벌제도가 재범률의 증가와 같은 심각한 문제점을 드러내고 있는 현실에서 유교적 인본주의에 충실했던 조선왕조 형벌제도 운영은 새로운 시각을 제공할 수 있다는 점에서 그 가치는 매우 크다고 할 수 있다.
Abstract
The purpose of study is to examine current penal system that is influenced from western criminal law and criminal justice systems. Through historical perspective, this study is compare current penal system to penal system in the Chosun Dynasty era. Under the influence of Confucianism, Chosun Dynasty’s penal system mainly focuses on “moral reformation”. Even though Chosun Dynasty takes assertive action against Confucianism social disorder, the basic premise of penal system is that actions made by persons under Confucianism social order. The basic premise of punishment in Chosun Dynasty is certainty, severity and celerity of punishment. In other word, judicial and penal policy in the Chosun Dynasty, the punishment must fit the crime. Especially, it deters abuse of punishment. Also, the “Humyul Policy” protects people from the severity of punishment such as cruel and unusual punishment. In other word, Chosun Dynasty mainly focuses on humanism and Confucianism rather than retribution such as an eye for an eye, a tooth for a tooth. Now a days, judicial penal code system rise to recidivism and any other seriousness problems. This study provides new perspective from study of Chosun Dynasty’s penal code system which influenced from Confucianism.
