선박충돌 과실비율의 의의와 그 산정방안

선박충돌에서 과실비율은 상당히 중요한 의미를 가진다. 상법의 선박충돌에서는 물적 손해는 과실비율에 따른 분할책임제도하에 있기 때문이다. 우리나라에서 과실비율산정은 실제적으로 해양안전심판원이 정한 원인제공정도를 활용하고 있다. 민사법원은 해양안전심판원의 재결내용에 구속되지 않는다. 독자적인 해사법원이 없는 우리나라에서 민사법원은 전문성이 떨어지는 편이다. 이러한 전문성을 보완하는 방안으로 필자는 감정제도, 전문심리위원제도 및 중재제도의 활용에 대하여 소개한다.
Abstract
Fault ratio in ship's collision case is very important. Physical damages are compensated in accordance with the fault ratio of each vessels involved in the particular collision case. In practice, the apportionment of liability for damages resulting from ship's collision is decided by the Korean MAIA's decision on the fault ratio. However, the civil court dealing with the collision damages is not subject to the MAIA's decision and are entitled to rendering its own judgment. The author explains several useful means for the courts to select such as maritime arbitration.
