Abstract
Marine accidents are caused mainly by negligence of personnel on board ships. In a collision case, the accident requires two or more ships to make it happen. Once it happens, it is often difficult to apportion liabilities among vessels involved. When an agreement is not reached, one party can sue the others in the civil court for the resolution of the dispute. Then the court provides a ruling on the proportional fault (PF) of the vessels involved in the collision. Based on the PF, they can easily apportion financial liabilities among themselves. On the other hand, the Korean Maritime Safety Tribunal (KMST) provides decisions on contributing proportion to the cause (CPC) to the vessels in collision cases. Although provided by different procedures and organizations, the CPC is in many respect similar to the PF: both apportion liabilities in numbers and are used in resolving disputes. However, many people have a hard time to understand the difference between the PF and the CPC. More specifically, they do not know MMST’s CPC, which was introduced in 1999. In this respect, the purpose of the paper is to analyse the legal characteristics of the PF and the CPC, and to highlight the difference of the two.
