거의 모든 분야에서 패러다임 전환이 일어나고 있는 이 시점은 법의 한계와 잠재력에 대해서도 재검토해야 하는 시점이기도 하다. 이 글에서 나는 이런 전환기 법철학의 과제를 염두에 두고, 우선 작금의 법사고에 나타나는 전환기적 흐름을 살펴보고자 한다. 그런 다음 이 흐름을 법철학 논의에서 중요한 장을 이루는 법실증주의와 자연법론에 비추어 보고자 한다. 전환기의 사고 흐름을 한 면으로는 법실증주의의 확장이라는 맥락에, 그리고 다른 면으로는 자연법론의 귀환이라는 맥락에 놓고 검토하는 가운데, 이를 바탕으로 자연법론의 현대적 의의를 정리해 보겠다. 법철학의 역사로부터 얻는 교훈은, 자연법성과 법의 실정성은 서로 수렴하는 방향으로 움직인다는 것이다. 이는 법실증주의든 자연법론이든 홀로 설 수는 없다는 것을 뜻한다. 그러므로 자연법론의 현대적 의의는 ‘인간다운 삶의 재건’이라는 관점에서 실정법에 위탁된 과제가 무엇인지를 묻는 물음으로 귀결된다. 동시에 이 물음은 지금 우리가 가지고 있는 법의 성공적인 패러다임전환 가능성에 대한 물음이기도 할 것이다. 나는 이 글에서 법의 동태학에서 법의 생태학으로 가는 전환시대의 법철학이 ‘제한법학’으로부터 벗어날 때 그 가능성이 열린다고 주장한다.
Abstract
In this paper I aim to discuss the problem of legal philosophy which is undergoing a transition. First of all this paper will look at the contemporary new trends of legal thinking, and reflect it from the aspect of the relation between legal positivism and natural law theory. And based on that, I will try to catch the dilemma of the natural law theory for the present time. The lessen which I learn from the history of the legal philosophy is that neither natural law theory nor legal positivism can stand alone. At the end I come to the conclusion that the significance of modern natural law will result in seeking the assignments that are referred to our positive laws. To keep this demand in mind, I point out that the legal philosophy of transitional period will succeed its paradigm change if it can be liberated from the ‘restrictive jurisprudence’.
