이 글은 생태위기나 팬데믹 같은 현대적 문제 해결에 법이 무력한 것에 문제의식을가지고, 그 원인을 근대적 법 패러다임에서 찾았다. 근대의 법 패러다임은 근본적인점에서 세계를 일종의 기계와 같이 보는 기계적 세계관에 근거하였다. 그러나 현대적문제들은 세계가 유기적으로 상호 연결되어 기계처럼 부분으로 환원될 수 없는 전체임을 보여주고 있다. 이 글에서는 그런 관점을 그물망 세계관으로 규정하고, 현대적 문제들의 해결을 위해 그물망 세계관에 적합한 법 패러다임으로의 전환을 촉구하였다. 그리고 그런 법 패러다임의 특징적 요소로서 관계적 주체로서의 인간의 지위, 공공을위한 자유의 연대, 위법성의 확률적ㆍ비례적 판단, 덕성과 감정의 복권, 그리고 법다원주의와 연성법의 수용을 제시하였다. 이런 특징들은 완전히 새로운 주장이라기보다는 이미 생태법학이나 포스트모더니즘법학, 또는 신 아리스토텔레스주의자들 등 기존의 주류 법학에 비판적인 입장들에서주장된 것들이다. 다만 이 글에서는 이들의 주장을 그물망 세계관의 관점에서 취사선택과 재해석을 통해 정합적인 패러다임으로 구성하고, 법 패러다임으로서의 정착을 위한 향후 과제를 제시하고자 했다. 앞으로 구체적 사례들에 적용을 통해 기존의 법 패러다임과의 치열한 유효성 경쟁이 일어나기를 기대한다.
Abstract
This paper critically examines the limitations of the modern legal paradigm in addressing pressing contemporary issues such as ecological crises and pandemics. It argues that these limitations stem from the mechanistic worldview underlying modern legal thought, which conceptualizes the world as a machine-like entity. However, contemporary challenges reveal the world to be an interconnected, organic whole, defying reduction to discrete parts. This paper conceptualizes this new understanding as a 'networked worldview' and advocates for a paradigm shift in legal theory to align with this perspective. Key features of this proposed legal paradigm include the recognition of individuals as relational subjects, the promotion of solidarity in freedom for the public good, the probabilistic and proportional assessment of illegality, the restoration of virtue and emotion in legal discourse, and the integration of legal pluralism and soft law. While these elements build on existing critiques within legal scholarship—such as ecological jurisprudence, postmodern legal theory, and neo-Aristotelian approaches—this paper reinterprets and synthesizes these ideas through the lens of the networked worldview. By doing so, it aims to establish a cohesive legal paradigm suited to the complexities of contemporary problems.
