현재 인공지능은 효율성과 혁신 측면에서의 장점을 이유로 산업 전반에 걸쳐 활용되고 있고, 미국과 유럽을 시작으로 법률서비스 분야에도 도입되어 그 영향력을 확대하고 있다. 최근 우리나라에도 변호사를 대상으로 하여 법률정보조사, 계약서 검토, 법률서면 초안 작성 등 인공지능에 기반한 서비스들이 출현하였고, 점차 확대될 조짐을 보이고 있다. 변호사의 인공지능 활용은 신중하게 검토하여 그 방향을 설정해야 한다. 특히 변호사는 국민의 기본적인 인권을 옹호하고 정당한 권리를 보호하는 역할을 한다는 점을 고려하면, 이러한 역할을 유지하면서 변호사가 인공지능을 올바르게 사용하도록 하고 이와 관련한 위험과 우려를 최소화할 필요가 있다. 본 연구는 이러한 문제의식을 기초로 변호사가 수행하는 업무인 법률사무에 있어서 인공지능의 활용과 변호사 윤리에 대해 검토하였다. 먼저, 변호사를 대상으로 한 인공지능 기반 서비스의 현황과 이와 관련한 변호사 윤리의 필요성을 살펴보았고, 미국, 영국, 호주, 일본 등 해외 주요 국가들의 관련 윤리규정을 검토하였다. 이를 바탕으로 인공지능 활용과 관련한 변호사 윤리의 기본원칙으로서 인공지능의 변호사 대체 금지, 업무 범위 확장을 위한 수단으로 활용금지, 변호사로서의 역량과 전문성 유지 원칙을 제안하였다. 그리고 의뢰인과의 관계를 고려한 윤리로서 설명 및 협의의무, 비밀유지 및 개인정보보호, 인공지능 활용과 관련한 역량유지, 인공지능 활용에 대한 책임을, 법원이나 수사기관 등과의 관계를 고려한 윤리로서 정확성 확인의무를 제안하였고, 인공지능의 불완전성과 관련한 윤리로서 편향성 방지의무와 감독의무를 제안하였다. 끝으로 이러한 인공지능 활용과 관련한 변호사 윤리를 규범화하는 방안으로 변호사 윤리장전 중 윤리강령을 개정하는 방안 또는 별도의 윤리규칙을 제정하는 방안을 제시하였고, 논의 내용을 반영한 구체적인 윤리규정 신설안도 제시하였다.
Abstract
Currently, AI is being used across industries due to its advantages in terms of efficiency and innovation, and its influence is expanding as it is being introduced to the legal services sector, starting with the United States and Europe. Recently, AI-based services for lawyers, such as legal information research, contract review, and drafting of legal documents, have emerged in Korea. And these are expected to gradually expand. The use of AI by lawyers should be carefully reviewed and its direction set. In particular, considering that lawyers play a role in upholding the basic human rights of the people and protecting legitimate rights, it is necessary to maintain this role and ensure that lawyers use AI properly and minimize the risks and concerns related to it. Based on this awareness of the problem, this study examined the use of AI and lawyer 's professional ethics in legal affairs, which is the work performed by lawyers. First, the current status of AI-based services for lawyers and the necessity of lawyer’s professional ethics related to them were examined, and the related ethical regulations of major overseas countries such as the United States, the United Kingdom, Australia, and Japan were reviewed. Based on this, the basic principles of lawyer’s professional ethics related to the use of AI are proposed: prohibition of AI as a substitute for lawyers, prohibition of use as a means to expand the scope of work, and the principle of maintaining competence and expertise as a lawyer. In addition, this study proposed the duty of explanation and consultation, confidentiality and personal information protection, capacity maintenance related to artificial intelligence utilization, and responsibility for artificial intelligence utilization as an ethics considering the relationship with courts and investigative agencies, and the duty to prevent bias and the duty of supervision as an ethics related to the incompleteness of artificial intelligence. As ethics related to the imperfection of AI, the duty to prevent bias and the duty of supervision are proposed. Finally, as a way to standardize lawyer’s professional ethics related to the use of AI, a plan to revise the Lawyers Code of Ethics among the Lawyer’s Professional Ethics Charter and a plan to establish separate ethics rules are proposed.
