Abstract
This study sought to determine whether the Preliminary Feasibility Study (PFS) system is fair. The fairness assessment focused on two dimensions: (1) project selection under the PFS and (2) economic feasibility analysis—specifically, cost-benefit analysis. First, PFS project selection lacks procedural fairness: (a) exemption provisions have been expanded and applied selectively, concentrating benefits within those provisions; (b) exemption categories have been broadened for political purposes; and (c) the final selection process for exempt projects remains opaque. Because these exemptions are extensive, this procedural weakness can erode distributive fairness. Second, cost-benefit analysis—rooted in Bentham’s quantitative utilitarianism—undermines procedural fairness by monetizing and aggregating disparate values, and it may further erode distributive fairness by justifying harm to a minority for the benefit of the majority. Third, since total costs and benefits cannot be estimated accurately and objectively, procedural fairness is compromised, which in turn can undermine distributive fairness. These findings contribute not only to the advancement of institutional and fairness theories but also to the refinement and operation of the PFS.
