Abstract

In an era where new technologies such as artificial intelligence continuously emerge, ensuring the appropriateness of regulations is increasingly emphasized, and recently, as issues related to industrial accidents have come to the forefront, interest in safety regulations has also risen. In this context, it is undeniably an important task to ensure that the “General Act on Administrative Regulation”, which serves as the basic law on regulation, exerts proper normative power. The “General Act on Administrative Regulation” defines “administrative regulation” as “matters stipulated in statutes, ordinances, or rules, whereby the state or local governments restrict the rights of citizens or impose obligations in order to realize specific administrative objectives.” However, many criticisms have been raised regarding the adequacy of this concept of “administrative regulation.” This article explores how to improve the regalation concept in this Act. This article first establishes three conceptual levels of regulation. In a narrow sense, regulation can be understood as administrative intervention in society based on formal norms such as statutes. In a broad sense, it can be seen as the state’s general intervention in society. In the broadest sense, it can be understood as social control in general. From this perspective, the regulation concept in the “General Act on Administrative Regulation” is close to the narrow definition of regulation. However, the Act’s regulation concept is excessively narrow because it limits the subject to the state or local governments, targets only the restriction of rights and imposition of obligations, and applies only to norms with legal binding force such as statutes. The narrow scope of the regulation concept in the Act stems from the fact that when the Act was enacted in 1997, the focus was on deregulation, and it was necessary to clearly specify the targets of deregulation. Recently, however, the regulatory environment no longer allows focusing solely on deregulation. There are cases where regulations must be strengthened to respond to new risks, and overall, improving the quality of regulations has become crucial. Therefore, it is necessary to establish a regulatory concept that fits the changed circumstances, and the regulatory concept in the Act should be improved accordingly. To this end, regulations imposed by public institutions should be included; the scope should be expanded beyond just the restriction of rights and imposition of obligations to encompass interventions that directly or indirectly affect citizens’ lives; and administrative rules without legal binding force should also be included within the concept of regulation. This approach aligns with the current reality of regulatory reform. When the regulation concept in this Act is broadened in this way, changes to the principle of legality in the Act regarding regulation are also required. Based on this expanded concept, the scope of registered regulations will widen, and it will be necessary to minimize unregistered regulations by enabling regulation registration based on artificial intelligence.
