Abstract

With the advancement of artificial intelligence (AI) in medical devices, new models have emerged that go beyond merely assisting medical professionals’ judgment, allowing patients to use AI-based healthcare tools in direct-to-consumer (DTC) forms—such as medical consultation chatbots or self-diagnostic mobile applications. Some argue that the use of such self-administered medical AI constitutes the unauthorized practice of medicine by unlicensed individuals. However, this view requires reconsideration in light of the conceptual distinction between a “medical device” and “medical practice.” The use of self-administered medical AI involves operating devices that are simple to use, generate results automatically, and do not require professional expertise for interpretation. According to the established legal definition of medical practice, which focuses on potential risks, such use does not constitute medical practice. Although these AI devices are highly sophisticated and may perform diagnostic functions, their operation merely involves automated computation based on data and parameters designed by humans. Therefore, the AI itself cannot be regarded as an autonomous actor performing medical procedures on its own initiative or judgment. Moreover, developers or medical professionals involved in the production and distribution of such devices do not directly engage in diagnosis or treatment for individual users. Consequently, while they may bear certain responsibilities related to the manufacture or sale of medical devices, they shall not be considered as practicing medicine themselves. The concept of medical practice is normative in nature and does not necessarily require identifying a hidden actor. Considering the negative aspects of expanding the scope of criminal liability for unlicensed medical practice, the relatively low risk posed by self-administered medical AI, and the possibility of ensuring safety through medical device regulation, it is not desirable to classify the use of such self-administered medical AI as unauthorized medical practice.
