인권의 담론이론적 정당화의 현황과 전망 - 하버마스, 알렉시, 포르스트의 논의를 중심으로 -

초록

이 글의 목적은 담론이론적으로 인권을 정당화하려는 시도들의 현황을 파악하고 이후의 논의방향을 타진해 보는 것이다. 이를 위해 본고는 우선 하버마스, 알렉시, 포르스트가 담론이론에 기초해서 어떻게 인권을 정당화하는지를 각각 비판적으로 검토한다. 그리고 이들의 인권 정당화의 모델들을 몇 가지 관점에서 서로 비교한다. 내가 보기에, 담론이론에 기초해서 인권을 정당화하고자 하는 시도들은 다음을 적절히 개념화할 수 있어야 한다. (1)정치적 맥락들 속에서 보다 정의로운 사회를 확립하기 위한 규준으로서의 기능을 수행하는, 인권 개념이 본래 지니고 있는 도덕적 열망으로서의 의미. (2)인권과 국민주권 내지 사적 자율성과 공적 자율성의 동근원성 (나아가 이와 연관된 법치국가와 민주주의의 내적 연관). (3)담론 내부의 자유와 평등이 행위의 영역의 자유와 평등으로 이전될 이론적 가능성. 이러한 비판적 현황파악에 있어 결정적으로 중요한 물음은 다음과 같다. 담론이 론은 말(담론)의 영역과 행위(인권)의 영역 사이의 구분을 제거하기 위해 추가적으로 전제해야 할―모든 사람에 대한 동등한 존중, 모든 사람의 자율성에 대한 인정, 도덕적 인격체로서의 모든 사람이 지닌 존엄성에 대한 인정 등과 같은―인권에 대해 구성적인 도덕적 핵심을 자신의 이론틀 내부에서 전개할 수 있는가? 이 물음에 대한 답변으로 나는, 하버마스의 기능적 정당화에 만족하지 않고자 하는 알렉시와 포르스트의 논의에 부분적으로 기대어, 담론이론은 인권의 궁극적 근거를 담론 외부로부터 추가로 도입하지 않고서는 인권을 정당화할 수 없다고 주장할 것이다.

Abstract

The aim of this paper is sketching the attempts that ground human rights on discourse theory, and examining the present state and prospect of the attempts. To achieve this, I critically investigate first how Habermas, Alexy, and Forst respectively justify human rights on the basis of discourse theory, then compare their models of justification from some standpoints. In my view, the projects trying to justify human rights on discourse theory must be able to properly conceptualize: (1)the meaning of human rights as moral aspirations that perform the functions as criteria for establishing more righteous society in political contexts, (2)equiprimordiality of human rights and popular sovereignty, and of private and public autonomy(and related the internal relation between the rule of law and democracy), (3)the theoretical possibility of transferring from freedom and equality inside the discourse to freedom and equality in the sphere of action. The following question is crucial to evaluate the success of discourse -theoretic justification of human rights: how can discourse theory develop in its own theoretical framework the moral kernel, which is constitutional to human rights and additionally required for eliminating the division between sphere of speech(discourse) and sphere of action(human rights), such as equal respect for all, recognition of autonomy of everyone, and recognition of dignity belonging to all human being as moral persons? To answer this question, I partially rely on the arguments of Alexy and Forst who are not satisfied with Habermasian functionalist justification, and shall insist that discourse theory can not successfully justify human rights without additional introduction of the ultimate ground for human rights outside the discourse.
