보호관찰 청소년 재범패턴에 대한 탐색적 분석: 왜 재범은 보호관찰 초기에 집중되는가?

보호관찰의 효과성에 관한 선행연구들은 보호관찰이 교도소 등 시설내 처우에 비해 재범방지 측면에서 다소 호의적 효과를 갖는 것으로 보고하고 있다. 특히 최근 증거기반 교정 원리에 근거한 새로운 보호관찰 프로그램들은 재범률 감소효과에 대한 기대를 한층 더 높여주고 있는 상황이다. 이러한 신선한 기대감에도 불구하고 보호관찰 청소년의 재범행동이 보호관찰 초기에 집중되고 그 후 부터는 가파르게 감소한다는 오랜 주장은 보호관찰의 효과성을 이해하는데 많은 도전을 제기한다. 본 연구는 이러한 오랜 주장의 타당성을 검증하기 위해 통상의 보호관찰 개시 후 재범패턴에 보호관찰 시작 이전의 비행 패턴을 추가하여, 보호관찰 청소년의 재범양태를 시계열적 관점에서 분석하였다. 이를 위해, 2019년 4분기에 보호관찰이 개시된 약 3,000명에 대해 보호관찰 개시 전후의 재범상황을 추적하였다. 분석 결과는 다음과 같다. 그동안 알려진 보호관찰 초기의 재범집중 현상은 보호관찰 개시와 함께 재범률이 급증하는 것이 아니라 보호관찰 개시이전의 높은 범죄율이 점진적으로 감소하는 현상으로 파악 할 수 있었다. 아울러, 보호관찰 개시 후의 점진적 재범감소 현상은 재범위험성이 높지 않은 청소년에게 더 두드러졌다. 최종적으로 보호관찰 개시 이전 단계에서 비행을 했던 청소년들은 보호관찰 개시 후 재범 가능성이 더 높았다. 이러한 연구결과를 바탕으로 정책 제언과 후속연구의 방향성을 제시하였다.
Abstract
Current status of evidence concerning the effectiveness of probation on recidivism is not clear, even though there has been an increase in the studies reporting promising results against the backdrop of a recent discourse on evidence based corrections. With regard to the effect of probation, especially perplexing would be the observation that most of recidivism occurs in the earlier period of probation. If there exists any recidivism reducing effect associated with probation, it would not make sense that such an high concentration of recidivism exists in the first 6 month of supervision. In this regard, the current study attempts to explore what might be the causes of this anomaly by comparing recidivism rates of 3,000 juvenile probationers during the first 6 month of probation with offending behaviors of the same probationers during the previous 6 month prior to probation. The results suggest that relatively high concentration of recidivism during the first 6 month indeed exists. However, it turns out that it was a part of a steady decline in offending behaviors following probation, rather than uptick in recidivistic behaviors. In addition, a further analysis showed that the variable predicted future recidivism measuring whether the juvenile committed crime during the 6 month prior to start of the probation order. Finally, this study concludes with future directions on how to make sense of the current findings along with future research directions.
