본 연구는 외출제한명령대상자의 재범 예측 요인을 도출하는데 있다. 외출제한명령은 재범위험성이 높은 소년 보호관찰대상자들의 생활양식이 주로 야간에 이루어지고, 소년범죄에서 다발하는 범죄들이 주로 사회의 감시가 소홀한 특정 시간대에 집중되는 것에 대한 보호관찰당국의 적절한 재범방지책 중의 하나이다. 분석자료의 모집단은 2004년부터 2011년 10월까지 보호관찰정보시스템(K-PIS)에 입력되어 있는 모든 외출제한명령대상자 44,637명이다. 모집단은 2006년부터 2010년까지 5년에 걸쳐 매년 100명을 무작위로 표집 한 500명 중 자료가 충실하게 입력된 450명을 분석대상이 되었다. 분석결과에 따르면, 외출제한명령대상자에 대한 재범률은 8.0%였다. 그리고, 외출제한명령기간 중 재범여부에 영향을 미치고 있었던 것은 보호관찰경력, 경고횟수, 음성감독기간 등이었다. 또한, 외출제한명령이 개시된 이후, 대상자가 새로운 범죄를 저지르는데 까지 걸리는 시간에서 보호관찰경력, 경고횟수, 음성감독기간 이외 성폭력사범 여부가 통계적으로 유의미한 영향을 미쳤다.
Abstract
The purpose of this study is to find recidivism prediction factors of offenders subject to curfew order. Curfew order is an appropriate recidivism prevention policy for probation of juveniles with high recidivism, whose lifestyle is concentrated during nighttime and when informal surveillance is low. Population for analysis is 44,637 offenders subject to curfew order registered in K-PIS from 2004 to October of 2011. A random sample of 100 subjects was taken for every year from 2006 to 2010, and from the total sample of 500 subjects, 450 subjects were chosen for analysis based on data integrity. Results of analysis show recidivism rate of offenders subject to curfew order was 8.0%. Also, statistically significant factors of recidivism rate were probation history, number of warnings and voice supervision period. In addition, statistically significant factors of time duration between the start of a curfew order and a new offence were probation history, number of warnings and history of sexual assault before voice supervision period.
