소년 구금시설 아동ㆍ청소년 인권보호를 위한 조사 강화 방안:영국 교도소 조사국 사례

Abstract

Due to the closed environment, violent incidents, abuse, and violation of human rights are likely to be ignored and unveiled in juvenile establishment as well as adult correctional facilities. That’s why regular independent inspections of correctional facilities are necessary and important. Currently, in Korea there are five types of juvenile establishments that hold under the age of 19. Although each department conducts inspections based on its purpose and characteristics, the results of inspections are not publicly presents. In addition, whether the juvenile establishment responds to the recommendations made by inspection is unknown. The purpose of this study is to review HM Inspectorate of Prisons’ inspections of juvenile establishments and provide policy implications for Korean juvenile justice system as a way of protecting children’s rights. Establishing independent inspection agency, developing standardized inspection method and criteria, releasing results of inspections and progress made by juvenile establishment, and developing inspection protocol aimed at protection of children’s rights are presented as policy implications.
