소년가석방자의 재범 위험요인에 관한 연구

교정시설에서의 수용기간 동안 수형성적이 우수하여 법무부로부터 가석방을 허가받은 소년가석방자들의 경우 사회로 복귀하여 재범을 저지르지 않고 사회에 적응하게 하는 국가적 차원의 노력이 요구된다. 이에 본 연구는 소년가석방자들을 대상으로 이들의 가석방 심사기준 자료들을 가지고 재범의 수준과 시기, 그리고 재범 위험요인을 규명하고자 범죄기록 관련 사전 배경요인, 교정시설 생활요인, 그리고 가족 관련 요인의 세 가지 범주로 나누어 생존분석을 이용하여 분석하였다. 본 연구의 결과 소년가석방자들은 조사대상 전체의 23.3%가 재범을 하였으며, 가석방 후 4개월째에 재범의 위험이 가장 높았으며, 매 4개월 마다 특징적으로 재범 위험률이 최고치를 보이는 것으로 나타났다. 소년가석방자의 범죄기록 관련 사전 배경요인 중에서는 형기, 입소전 알코올문제, 실형전력 등이 유의미하게 영향을 미치는 것으로 나타났고, 교정시설에서의 생활요인 중에서는 잔형기와 집행률이, 그리고 마지막으로 가족요인 중에서는 가족의 보호의지와 가족의 접견상황이 소년가석방자의 재범 위험률에 유의미하게 영향을 미치는 것으로 나타났다. 이러한 결과들을 볼 때에 사회복지사 등 전문가의 적극적인 개입을 통한 알코올․약물남용문제 치료프로그램 등 소년수형자에 대한 교정시설 내에서의 특화된 교정교화프로그램 및 가족과의 유대증진을 위한 특별대책의 요구되며, 소년가석방자의 출소 이후 사회적응 기간에서 보호관찰찰소 등 사회내 처우기관과의 체계적 연계와 귀주예정지 환경개선활동 등의 활성화가 필요하다.
Abstract
Juvenile Parolees who have been released on parole with a good prison-service record are expected to be reintegrated to the community without committing further crimes. This study aims to identify survival periods of juvenile parolees and the risk factors of recidivism with the method of survival analysis. The risk factors are composed of three categories, that is, criminal records factors, correctional facility factors, and family factors. The result of this analysis is summarized as below. Firstly, 23.3% of juvenile parolees have re-offended within one and half year. Secondly, they have a highest hazard rate in fourth month and particularly have a maximum hazard rate every quarter of a year. Thirdly, certain variables of three categories can be treated as predictors for recidivism of juvenile parolees. For example, among the criminal records factors, the term of imprisonment, alcoholic problems before imprisonment, records of prison sentence are appear to be meaningful variables for the hazard rates recidivism of juvenile parolees. Among the correctional facility factors, remaining periods of a prison term and execution ratio are meaningful. And Such variables including family reception frequency and family protective readiness among the family factors resulted to be statistically significant. With these results, it can be inferred that we need to invest more money and energy in developing and implementing specialized programs and policies to reduce rates of re-offending. These programs and policies include rehabilitation efforts that target known re-offending risk factors, correctional treatment programs for juvenile inmates with prior alcoholic problems and special measures for improving family-juvenile inmates relationship. And these specialized programs are strongly recommended to be managed by professional practitioners such as social workers. And it is also very important to promoting the cooperation with community based treatment agencies such as probation and parole offices and improving living arrangements of offender's family and future residence.
