Abstract

This study focuses on the key issues of authorship, rights, and responsibilities in AI-generated artworks, which have been rapidly increasing in recent years. Currently, most countries’ copyright laws define authors as humans, so AI-generated works are not granted copyright. However, copyright is partially recognized only when humans creatively intervene in AI results through selection, arrangement, or modification. This study reviews cases that have sparked various discussions on copyright both domestically and internationally, and critiques the legal and ethical attitudes that still view AI solely as a “tool” for creation, based on South Korea’s “A Guide on Generative AI and Copyright.” In the reality of AI technological innovation that transcends simple tools, and for the coexistence of humans and AI, this study proposes the possibility of AI having rights and responsibilities as a legal entity in the future, as well as the necessity of institutional reform.
