Abstract
For years, computers have dominated humans at chess, poker, and baduck. Now, they are competing in the arts. Increasingly sophisticated artificial intelligence is creating music, art, and stories. It has given rise to provoking questions in copyright law: Is a work created by autonomous artificial intelligence copyrightable? Who is the copyright owner of a work created by autonomous artificial intelligence.? This article explains why copyright protection should not subsist in original works made by artificial intelligence without natural person’s creative input. According to the purpose of copyright law, which is to encourage human to create, it is not appropriate to protect works created by autonomous artificial intelligence because it may discourage human from making new creative work. This article then analyzes the arguments for and against the possible choices of copyright owner: the artificial intelligence, the user, the programmer, and entrance into the public domain. Then this article arrives at the conclusion that the work’s immediate entrance into the public domain is the best approach to resolving the question of copyright ownership of works created by autonomous artificial intelligence. Because no person generates the artificial intelligence’s work, no person should be awarded the copyright and everyone is free to use the artificial intelligence’s work. The artificial intelligence industry will likely continue to thrive regardless of copyrights, and this approach would help ensure that humans remain an integral part of creative fields.
