젠더폭력에 대한 경찰의 대응방안 : 친밀한 관계의 여성 살해 후 자살을 중심으로

초록

본 연구는 젠더폭력은 여성에 대한 인권침해 행위이자 성차별적 사회구조 및 권력위계의 문제라는 본질적 맥락에서 경찰이 접근하고 개입하기 위한 대응방향을 모색하는데 궁극적 목적을 두었다. 이를 위해 우선 젠더폭력의 가장 오래되고 심각한 형태의 범죄인 ‘친밀한 여성 살해 후 자살(IFS)'의 본질적 특징과 발생맥락을 범죄발생률과 주요 범죄특징, 위험요인을 중심으로 국가간 비교분석하고, 이러한 범죄 전반을 관통하고 있는 젠더불평등적 요소를 발견하고자 하였다. 분석결과, 우리나라는 외국에 비해 가해자와 피해자의 연령이 높고, 하류층 가해자가 많았으며, 살해방법과 자살방법이 각각 다르고, 범행동기가 불분명한 경우가 많은 것으로 나타났다. 또한 친밀한 여성 살해 후 자살의 특징적 위험요인을 통해, 각국의 여성살인사건의 집계방식의 차이가 가져오는 통계품질의 빈약성, 가해자의 사회계층적 차이와 형사사법처리 방식의 상관관계, 범행의 사전계획성, 여성에 대한 통제력과 소유욕이 이러한 젠더폭력에 내재된 본질적 특징임을 확인하였다. 이와 같은 젠더폭력에 대한 경찰의 기본 대응방향으로써, 본 연구는 Stark(2012)가 기존 ‘폭력사건 중심의 개입방식’에 대한 대안으로 제시한 ‘강압적 통제 모델’로 전환할 필요가 있음을 제안하였다. 구체적인 방안으로서, 젠더폭력에 대한 보다 근본적이고 선제적 대응을 위한 강압적 통제 모델을 경찰개입전략에 적용하고, 친밀한 관계의 여성 살해 후 자살과 같은 치명적 결과를 사전예방하기 위한 개입방안을 수립하며, 젠더폭력사건의 위험성 평가를 통한 피해자의 사전 안전 확보 전략을 모색하는 한편, 젠더폭력에 대한 공식통계 품질의 향상을 제시하였다.

Abstract

This study defined that gender violence as an act of human rights violation to women in terms of gender imbalance which is a problem of gender discrimination and power hierarchy, and analyzed intimate femicide-suicide(IFS) as the most extreme form of gender violence. Through this measure, the police ultimately sought a proper response to such gender violence. To this end, this study investigated and analyzed the results of preceding researches among domestic and foreign countries focusing on the incidence of crime, major crime characteristics, and risk factors on intimate femicide-suicide through systematic literature analysis methods. The results show that it has a higher age of perpetrators and victims than other countries, a higher number of lower class perpetrators, the differentiation between killing and suicide methods, and unclear motives in Korea. Also, through the characteristic risk factors of intimate femicide-suicide, this study found out that the social class difference and the criminal justice system of the perpetrators brought about by differences in the methods of aggregation of female murders in each country. As a basic response by the police to this issue, this study was intended to be a 'coercive control model ' proposed by Stark(2012) as an alternative to the violent incident model. As a concrete measure, a violent incident model for more fundamental and preemptive response to gender violence was applied to the police strategy, and a deadly result such as suicide after the murder of a woman in a close relationship was prevented.
