젠더기반폭력으로서 친밀 관계 폭력의 특성과 쟁점: 현장의 지원 경험을 중심으로

본 연구는 젠더기반폭력으로서 친밀 관계 폭력의 현황과 특성을 살펴보고 피해자 지원제도의 효과성 및 문제점을 파악하여 관계적 친밀성에 기반한 젠더폭력 대응의 방향성을 현장의 경험을 중심으로 논하기 위한 것이다. 이를 위해 여성폭력, 가정폭력, 성폭력, 스토킹 및 LGBTQ 피해자 지원기관 활동가 총 16명에 대한 심층면접을 수행하였다. 분석 결과 현장에서 접하는 대다수의 친밀 관계 폭력은 친밀한 파트너 폭력(IPV)의 맥락에서 발생하고 있었다. 친밀한 관계의 맥락은 폭력의 위험성과 심각성을 가리고, 폭력에 대한 인식과 대응을 어렵게 하고 있었다. 가정폭력과 교제폭력은 친밀한 파트너 폭력이라는 공통의 맥락에서 성별화된 피해의 발생과 효과, 피해자 비난 등의 특성을 공유하고 있었고, 친밀 관계 폭력의 불균형한 발생과 효과는 성정체성, 성적 지향 등의 맥락과 교차하면서 더욱 강화되는 양상을 보였다. 결론에서는 다양한 친밀 관계에서 발생하는 폭력 대응을 위한 가정폭력처벌법 전면 개정, 직장에 다니는 피해자를 위한 고용안정성 지원정책 마련 등 피해자 보호ᆞ지원을 위한 법제도적 대응의 방향에 대해 제시하였다.
Abstract
This article examines the characteristics and issues of intimate relationship violence as gender-based violence. To do so, it carried out in-depth interviews with 16 activists affiliated with groups that provide assistance to victims of violence against women, domestic violence, sexual abuse, stalking, and violence against gender minorities. Findings of its investigation revealed that the predominant occurrence of intimate relationship violence takes place in the context of intimate partner violence. The complex nature of personal relationships obscures the potential danger and seriousness of violence, hindering the ability to identify and address instances of violence. Domestic violence and dating abuse have similar characteristics of harm, such as gendered victimization and victim blaming, typical aspects of gender-based violence against women. Furthermore, intimate partner violence occurs disproportionately and has varying effects on victims depending on the intersectionality of their gender identity and sexual orientation. The results of this article suggests that complex and diverse practices of intimacy in the contemporary society should be taken into account when establishing a legal framework to respond to gender-based violence. One of these recommendations is a thorough overhaul of the Domestic Violence Punishment Act, which would handle violence in a variety of intimate relationship.
