Abstract
This study highlights the necessity of introducing a Domestic Homicide Review in order to prevent femicides occurring in intimate relationships such as dating and domestic violence. Internationally, intimate partner homicide is recognized as a crime rooted in gender-based structural inequality and unequal power relations, with the United Nations and several countries having already institutionalized fatality review mechanisms as preventive measures. In South Korea, however, systemic shortcomings —such as the application of non-prosecution upon victims’ request, the absence of clear criteria for identifying mutual assault, limitations of digital protection devices, and insufficient recognition of stalking behaviors—have repeatedly exposed victims to ongoing risks. An analysis of two actual cases demonstrates that inadequate initial police response, failure to conduct high-risk assessments, and insufficient legal safeguards ultimately resulted in the deaths of victims. Based on these findings, this study proposes a set of comprehensive policy reforms: the prompt enactment of the Domestic Homicide Review system, the inclusion of dating violence within the legal category of domestic violence, the criminalization of coercive control, the establishment of more effective victim protection and offender monitoring mechanisms, the enhancement of police training including risk assessment, the development of gender-disaggregated statistics and data systems, and the empowerment of national coordination bodies for gender-based violence. By repositioning violence in intimate relationships not as a private issue but as a structural social problem, this study underscores the urgent need for systemic transformation to safeguard women’s safety and right to life.
