본 논문은 현재 대통령령으로 시행되고 있는 「공공기관의 갈등예방과 해결에 관한 규정」, 국회에 제출된 2개의 갈등관리 법안, 그리고 대통령자문 사회통합위원회의 갈등관리법안을 중심으로 갈등관리 법･제도가 어떠한 방향으로 진행되고 있는지를 분석하고 문제점을 파악한 후 향후 우리나라의 갈등관리 제도화가 어떠한 방향으로 나아가야 할지를 분석하고 있다. 분석 결과, 현재 시행되고 있는 갈등규정은 적용범위에서 한계가 있고, 갈등예방에 효과적이지 않으며, 갈등관리심의위원회가 형식적으로 운영되고 있다는 문제점이 있다는 점이 지적되었다. 국회에 제출된 2개의 갈등관리법안 역시 갈등예방에 관한 규정이 전혀 없다는 점 등이 문제로 지적되었다. 사회통합위원회의 갈등관리법안 역시 이전의 법률안을 보완하려는 노력을 보이고 있지만 ‘갈등의 사후영향평가 실시’, ‘갈등관리실태 점검･평가 결여’ 등의 측면에서 문제점이 지적되었다. 이 같은 분석결과를 바탕으로 향후 우리나라의 공공갈등관리를 제도화할 경우에는 각 부처로 하여금 ‘갈등예방에 적극적으로 나설 수 있는 인센티브 마련’, ‘일정한 요건에 해당되는 정부정책이나 사업의 사전의견수렴절차에의 회부’, ‘정부의 갈등관리실태･점검의 강화’, ‘갈등관리심의위원회 제도의 개선’ 등의 정책방안이 제시되었다.
Abstract
This thesis analyzes "the provision for conflict prevention and resolution of public institutions", two bills submitted to the National Assembly and conflict management bill of the Presidential Commission for Social Integration(the Social Integration Commission), and finds out some problems of those bills, and presents which direction those bills go forward. The results of such analysis show that the provision has some limitation in the range of enforcement, and is not effective in the prevention of conflict. Those two bills submitted to the National Assembly are also pointed out that they do not contain any conflict prevention related contents. The bill drafted by the Social Integration Commission also has some problems in the aspect of posterior impact analysis and absence of check and evaluation of conflict management performances. The policy recommendations presented by this thesis are as follow; the need for giving incentives for those agencies that strive for preventing the conflicts rather than resolving the conflicts, the need for imposing deliberation process on those government policies and programs that meet some criteria, the reinforcement of check and evaluation of conflict management performances, and the need for improving the function of conflict management committee of each agency.
