Abstract

The article explores the research question of “Why the International Court of Justice cannot play the role of guardian?” To answer the question, the paper applies the international institutionalism and analyzes how the Court’s interpretive power has been restrained by the U.S. policies. As the U.S. Supreme Court history illuminates, political deference and compliance on court’s landmark decisions are essential for a judicial organ’s review autority to be established. In the case of International Court of Justice, however, no equivalent political customs have ever existed. In the Nicaragua case, the U.S. denied ICJ’s jurisdiction and did not comply with its decisions. Furthermore, the U.S. prioritized a political and diplomatic compromise with Libya in the Lockerbie case rather than allow the ICJ deliver a verdict. In the end, the analysis demonstrates that the features of Constitutional order in international society are still far from an ideal self-restraint model, even though the possibility of future evolution cannot be ruled out.
