Abstract

The U.S. has led international politics and the international legal order, but it does act differently from other countries. This article will explain America’s actions that are frequently distinct from other countries in international relations, and it will focus on analyzing and assessing the meaning and effect of such actions in the international legal order. The U.S. takes an exceptionalism approach in foreign relations, particularly with regard to relations pertaining to international law. Exceptionalism grows out of the notion that the U.S. carries distinct characteristics from other countries such as in origin, principles, historical development and system of the U.S. Also, this exceptionalism is derived from superpower’s propensity to be free from binding rules of international law, as a result of a messianic call and enlightening sense of duty of the U.S. to spread America’s liberal democracy to the world. America’s exceptionalism utilizes the following: (1) first, not ratifying a treaty, which it has signed to, or not complying with the treaty that it has ratified based on ‘immunity’, (2) ‘double standards’ that apply strict standards to hostile nations, but apply more general or permissive standards to nations that are friendly to the U.S., (3) ‘legal isolationalsim’ that makes it possible for the U.S. domestic legal order to be cut off from external norms by blocking the domestic application of international law. When viewing America’s exceptionalism approach from the perspective of the ‘rule of law’, it cannot be referred to as ‘substantive rule of law’, but rather as a ‘formal rule of law’, and more specifically to the thinner theory of ‘rule by law.’ Furthermore, in view of strengthening the notion of ‘international rule of law,’ the U.S. has much to contribute to the ‘international rule of law’ as it acts as the new (principal) drafter of the new international order. However, this article is pessimistic in terms of the contribution the U.S. can make to the ‘international rule of law’ if the U.S. decides to establish a new international order based on its sense of duty to spread America’s liberal democracy across the world.
