포괄적 네거티브 규제혁신의 성과와 함정

문재인 정부에서는 제4차 산업혁명이라는 기존의 산업구조와는 차원이 다른 환경변화에 직면하자 포괄적 네거티브 규제로 대표되는 혁신적인 규제개혁을 표방하면서 경로창조를 시도하였다. 이러한 맥락에서 이 연구는 문재인정부의 4차 산업혁명과 관련된 규제개혁의 핵심이라고 볼 수 있는 포괄적 네거티브 규제방식의 성과와 한계를 집중적으로 분석하였다. 2017년 이후 9,000여건 이상의 포괄적 네거티브 규제혁신의 성과가 나타났다. 입법방식의 유연화를 통해 신산업의 진입장벽이 완화되었고, 2019년 이후 행정규제기본법을 포함한 규제혁신 7법, 즉 규제샌드박스 입법완성과 규제혁신 3종 세트의 도입으로 규제 신속 확인, 임시허가, 실증특례 등이 획기적인 성과를 보이기 시작했다. 그러나 현장의 전문가들과 이해관계자의 의견을 경청하면, 규제혁신과정에서 의제설정이 제한되는 무의사결정의 함정, 부가조건이 붙어 다른 규제가 증가하는 규제의 누적적 증가현상의 함정, 규제대상기업이 전문지식이 부족하고 준비가 되어있지 않아 발생하는 기회주의 속성과 도덕적 해이의 함정, 당사자 간의 이해관계 충돌로 인한 규제갈등의 함정 등 예기치 못했던 다양한 규제혁신의 한계가 나타났다. 이러한 규제혁신의 함정을 예견하고 사회경제적 편익과 비용을 고려하는 규제혁신 방안을 제안하면 다음과 같다. 무의사결정이 진행되기 전에 소통하고 협력하는 장치마련이 필요하다. 부가조건을 면밀하게 분석하여 불확실성에 대비할 필요가 있다. 규제대상자의 기회주의적 속성을 막는 인센티브 메커니즘을 작동시킬 필요가 있고, 규제갈등 해소장치의 마련이 필요하다. 특히 4차 산업혁명에 따른 혁신성장 과정에서 새로운 산업의 시장 진입으로 인한 다양한 갈등을 해결해나가는 정부의 조정 역할도 요구된다.
Abstract
The purpose of this study is to find the performance and limitations of regulatory reform in the period of the 4th Industrial Revolution. Three types of governmental regulation is composed of economic regulation, social regulation and administrative regulation by OECD, and regulatory reform is mainly concerned about entry regulation of economic regulation. Regulatory reform of economic regulation is made up of legislation style reform and regulatory sandbox in viewpoint of comprehensive regulation system. The performance of regulatory reform is made up of seven core regulatory legislation by regulatory governance, a set of three kinds of regulatory innovation like rapid recognition of regulation, temporary permission, and exceptional experimental permission, twenty-four regional free zones of regulation. In the contrary there are various kinds of pitfalls of regulatory reform like those of non-decision-making, pyramiding regulation, moral hazard based on opportunism and free-rider problem, and regulatory conflict. So I suggest that government should consider hearing from voices of industrial field to avoid non-decision-making, monitoring regulatory process and additional conditions of main regulation continuously to avoid pyramiding regulation, building up collaborative governance for the acceptance of stake-holders to avoid opportunism and moral hazard, setting problem solving first priority. Above all conflict mediation and resolution, communication and collaboration between government and enterprises should be needed.
