한국 규제개혁정책의 역사와 전망: 역사적 신제도주의의 관점에서

초록

한국의 규제개혁정책은 1998년 「행정규제기본법」이 제정되면서야 비로소 본격화되었다. 본 연구는 김대중 정부 이후 규제개혁정책의 변화 양상과 원인을 살피고 향후 변화를 전망해보는 데에 목적이 있다. 규제개혁정책의 변화를 신규 규제에 관한 것과 기존 규제에 관한 것으로 나눠 분석하였는데, 진보적 정부와 보수적 정부 간 정권교체가 있었음에도 불구하고 규제완화 중심의 정책은 계속된 것으로 확인됐다. 최근 포괄적 네거티브 체계로의 전환과 신산업에서의 규제샌드박스 도입 등의 새로운 변화가 시도되고 있다. 그러나 「행정규제기본법」과 규제개혁위원회 중심의 체계 내에서 단절적 변화가 발생했다고 평가하기는 어려울 것이다. 저성장 국면에서 현행 체계를 유지한 채 정부는 기업의 애로 사항을 해결하고 신기술과 신산업 발전을 촉진하고자 노력을 지속하고 있는 것이다. 당분간 한국의 규제개혁정책은 현재와 같은 추세를 유지할 것으로 보이나, 4차 산업혁명 기술 기반 제품과 서비스가 보편화되는 시점에 단절적 변화가 발생할 수 있다. 따라서 이에 대한 정부와 학계의 준비가 필요할 것이다.

Abstract

Regulatory reform policies in South Korea have been developed since 1998 when the Framework Act on Administrative Regulation was enacted. The purpose of this study is to examine both trends and causes of the changes in the regulatory reform policies and to discuss future changes. Changes in regulatory reform policies were analyzed from two perspectives; reforms of new regulations and existing regulations. For recent 20 years deregulation has continued in Korea despite multiple switches of governmental power between progressive and conservative parties. Recently, in order to effectively respond to the 4th industrial revolution, some changes such as a comprehensive negative system and a regulatory sandbox have been being made. In this circumstance, it seems that punctuated changes could not happen. While maintaining the current system in a low-growth phase, the government is making efforts not only to overcome difficulties faced by enterprises but also to support the development of state-of-the-art technologies and industries. Therefore, the regulatory reform policies in South Korea would maintain the current trend. However, we believe that punctuated changes may occur at the time when products and services based on the 4th industrial revolution technology become common. In conclusion, this study suggests that the government and academia should prepare for the unprecedented changes.
