방송통신위원회 논의의 한계와 개선방안

방송통신융합 현상과 관련해서 한국에서도 융합논의가 지속되고 있다. 그러나 그러한 논의는 근본적으로 이를 주장하는 주체가 누구이냐에 따라서 기본적인 한계가 있기 마련이다. 정작 융합현상에 대한 대응 내지 반영으로서 법제도의 융합 차원에서 방송통신위원회의 논의가 진행되고 있다고 하나 융합현상의 본질이나 이에 따른 정책과 규제의 방향성에 대한 재고가 충분히 이뤄지지 않았다. 일부는 지나치게 외국의 사례에 의존하면서 방송통신위원회가 대세라는 식의 대세추종론적 주장을 하고 있는 가운데 과연 방송통신위원회가 필요한가에 대한 검토나 단일 규제기구의 모습이 반드시 방송통신위원회인 것이 바람직한가에 대한 충분한 검토도 없었다. 따라서 작금의 상황은 방송통신위원회 논의 자체가 사상누각적 상태에 있다고 볼 수 있다. 논리보다는 주장으로, 이성보다는 감성으로, 현실보다는 이상만으로 해당 사안을 접하게 되면, 그것은 추구하는 목표와 그를 통한 성과를 기대하기 어렵게 한다. 이러한 점을 감안하여 한국에서의 방송통신위원회의 유용론적 접근과 무용론적 접근을 통하여 보다 바람직한 논의의 개선방안을 모색하고자 하였다.
Abstract
Convergence is the theme that everyone talks about, but no one is sure what it means. Although there aren’t debates on the philosophy of converging communications, current concerns focus on the establishment of converging regulatory authority, Broadcasting & Telecommunication Committee. Therefore this study is intended for those who need to figure out the meanings of convergence to decide public policy for converging communication industries. Especially this study analyzes some perspectives of Broadcasting & Telecommunication Committee as a regulatory authority in the convergence age. Convergence occurs when technological change erodes the boundaries between what were once distinct markets or industries. Convergence raises two primary policy concerns: first, the potential need for converging regulatory system, second, the benefit from converging regulatory system and the cost of establishing the system. Changes are found in the regulatory system of other countries coping with the converging situation. Now in Korea, we find the changes taking place in the technology, services and enterprise. Regulatory system has to be reformed to cope with the trends. But we don’t have to fall into a pit. It is risky to make a regulatory system before sharing the philosophy of convergence. Therefore, without supporting by the philosophy, there are only fruitless discussion.
