본 연구는 유럽연합이 점점 강화되고 있는 규제들로 인해 이민․망명자들의 인권이 침해받고 있다는 비난을 극복하기 위해 취하고 있는 조치를 리스본 조약의 기본권헌장, 가입후보(예비)국 재정지원정책 그리고 주변지역정책(ENP)이라고 규정하고 있으며, 그것이 어떠한 성과를 나타내고 있는지에 대해 고찰하고 있다. 이를 위해 리스본조약에서 기본권헌장의 구속력이 가지는 영향력과 가입후보(예비)국에 대한 재정지원정책 그리고 주변지역정책이 가지는 의미와 그것의 결과에 대해 살펴본다. 법적 구속력이 없어 역할을 제대로 수행하지 못하였던 기본권헌장은 리스본조약의 발효로 법적지위를 가지게 되었고 이것은 회원국에게 영향을 끼쳐 제3국의 이민․망명자들에 대한 인권보장에 긍정적인 영향을 끼칠 것으로 전망된다. 가입후보(예비)국에 대한 재정지원정책과 주변지역정책 역시 파트너국가들이 대부분 유럽연합으로의 이민과 망명 희망신청이 높은 국가들로 양자 간 합의 시 상호간 인권보장과 관련하여 구체적인 합의가 가능할 것으로 예상된다. 이러한 정책은 유럽연합과 개별회원국간의 입장차를 효율적으로 조절한 사례라고 볼 수 있을 것이다. 이민․망명자들의 인권보장을 위한 유럽연합의 이러한 노력은 다문화사회로 심화되고 북한으로부터의 망명자가 증가하고 있는 한국 사회에 큰 정책적 시사점을 줄 것이다.
Abstract
This paper explores social exclusion in the EU and its overcome. The EU through the Treaty of Lisbon and the European Neighbourhood Policy (ENP) to overcome Social exclusion of European Union. Social exclusion is a multidimensional concept covering a remarkably wide range of social and economic problems. Social exclusion reflects a process of progressive social rupture, detaching groups and individuals from social relations and institutions. European countries have historically tended to focus on providing social and economic rights only to citizens, excluding foreigners living within their territory. The Treaty of Lisbon entered into force on 1 December 2009. The Lisbon Treaty makes the Charter of Fundamental Rights a legally enforceable document not only on the EU, its institutions, and the member states as regards the implementation of the European law. The European Neighbourhood Policy (ENP) was developed in 2004, with the objective of avoiding the emergence of new dividing lines between the enlarged EU and our neighbours and instead strengthening the prosperity, stability and security of all. The Treaty of Lisbon and ENP policy tools help to redress or amplify the factors behind social exclusion in the region
