본 본문의 목적은 중앙선거관리위원회(이하 선관위)가 최근에 제시한 선거제도 개선방안의 작동방법을 제18대와 제19대 국회의원선거에 이 방안을 적용하여 설명하고, 나아가 이 방안의 문제점이 무엇인지를 검토하는 데 있다. 이 논문의 분석은 첫째, 비례대표선거의 명부상 동일순위에 배치된 동시입후보자 중 당선인을 결정하는 방법과 초과의석을 인정하는 병용식 선거제도는 불공정한 선거결과를 초래하는 정치인 혹은 정당의 전략적 행동을 유발할 수 있다는 것을 보여준다. 둘째, 이 논문의 분석은 또한 초과의석의 발생으로 비수도권이나 농촌지역이 오히려 권역별 인구대비 의석수 기준에서 불리해질 수 있다는 것을 보여준다. 마지막으로 이 논문은 선관위안에 대한 대안을 제시하고, 이 대안이 지역주의 혹은 지역구도의 완화 등 선관위안이 의도한 효과를 달성할 수 있는지를 선관위안과 비교하여 분석한다.
Abstract
The aim of this paper is to explain how recent electoral reform proposal by the Korean National Election Commission operates by applying it to the 18th and the 19th National Assembly Election and to check whether there is any defect in it. The analysis in this paper first shows that both the method of determining who gets the list seat among the defeated constituency candidates who are listed at the same rank and the compensatory mixed system with overhang seats provide strong incentives for strategic behavior by politicians or parties leading to unfair electoral results. This paper also shows that, due to the likely existence of overhang seats, non-metropolitan regions and rural areas are at disadvantage in terms of final seats assigned to each Electoral Region. This paper also proposes an alternative to the Commission's proposal and shows how it works in terms of achieving the intended effects of the Commission's proposal including ameliorating regionalism.
