독일식 연동형 선거제도 도입의 쟁점과 과제: 초과의석 문제의 해법을 중심으로

이 논문의 목적은 현행 국회의원 선거제도의 대안으로 논의되는 독일식 연동형의 도입방안을모색하는 데 있다. 독일식 연동형에서 발생하는 초과의석은 비례성의 저하와 의원정수의 유동성을 초래하여 제도도입의 가장 큰 장애로 작용할 수 있다. 그러나 초과의석이 발생했을 때 권역간 조정 또는 정당 간 조정을 사용하여 차단하면 높은 비례성을 유지하면서 의원정수의 유동성도 막을 수 있다. 지난 20대 총선에 이 방식을 적용하면 현행 병립식보다 비례성 제고와 의석수확대 차단에 있어서 유의미한 결과를 보이는 것으로 나타난다. 비례의석의 비율을 설정하는 문제는 초과의석의 발생에 크게 구애받지 않기 때문에 지역구의석 대비 3:1 수준으로 소폭 확대하는 것이 적정할 것이다. 명부작성단위는 전국명부보다는 권역명부가 지역대표성의 보완 및 지역주의 완화의 효과를 보이므로 바람직하다고 할 수 있다.
Abstract
In the German electoral system the parliament’s size may increase and result also in diminishing the proportional representation due to the occurrence of overhang seats. For that reason, the success of the German system depends on resolving the overhang seat issue. Inner-party compensation for internal overhang and inter-party compensation for external overhang present an effective solution for blocking overhang seats. These selective applications of the compensation model could guarantee proportional representation and prevent the enlargement of the assembly’s size. The simulation result shows that applying the German election system with the compensation model to the 20th Korean parliament election creates a much more proportional assembly than does the current Korean election system.
