대한민국 어린이헌장 제5조에서는 “어린이는 즐겁고 유익한 놀이와 오락을 위한 시설과 공간을 제공받아야 한다.”고 정하고 있다. 이는 우리 사회의 미래이고 소망인 아동에게 놀이가 중요한 가치를 지닌다는 것을 되새기게 한다. 아동의 인격 발달과 발현에 결정적인 영향을 미치는 놀이를 제도적으로 보장하는 작업은 아동의 놀 권리에 대한 기본권적 지위를 확인하는 데에서 시작되어야 한다. 아동의 놀 권리는 헌법 제12조 제1항 전문에서 정한 신체의 자유, 헌법 제17조에서 정한 사생활의 자유 및 헌법 제10조의 행복추구권에서 파생되는 일반적 행동자유권에 근거한 구체적인 권리로서의 실질을 가지므로 기본권으로 인정될 수 있다. 아동이 놀 권리의 주도적 행사가 가능할 정도로 신체적･정신적으로 성숙하였다면 놀 권리의 기본권행사능력을 인정하여야 한다. 아동의 놀 권리는 인격의 형성에 기여한다는 점에서 교육받을 권리와 그 실현가치를 공유한다. 부모의 자녀양육권도 아동의 행복을 궁극적인 목표로 한다는 점에서 아동의 놀 권리와 충돌하는 것은 아니지만, 현실에서 두 기본권의 충돌사례는 어렵지 않게 찾아볼 수 있다. 결국 두 기본권이 조화롭게 양립할 수 있도록 아동의 주체적 의사결정능력이 인정되는 경우에는 부모의 자녀양육권을 아동의 놀 권리에 양보하여야 한다고 본다.
Abstract
Article 5 of the Korean Children’s Charter stipulates, “Children should be provided with facilities and space for fun and beneficial play and entertainment.” This reminds that play has important value for children who are the future and wish of our society. The work of institutional assurance of play that has a decisive effect on the development and expression of a child’s character should begin with identifying the basic rights status of the child’s right to play. A child’s right to play can be recognized as a basic right because it has the substance of a specific right based on the freedom of the body set out in the text of Article 12 paragraph 1 of the Constitution, the freedom of privacy set out in Article 17 of the Constitution, and the right to general freedom of action derived from the right to pursue happiness in Article 10 of the Constitution. If children have matured physically and mentally enough to take the initiative in the right to play, they should recognize their basic rights to play. Children’s rights to play share their rights to be educated and their real value in that they contribute to the formation of personality. Parents’ right to adopt children does not conflict with children’s right to play in that it is the ultimate goal for children’s happiness, but in reality, the two basic rights clash is not difficult to find. In the end, if a child’s self-contained decision-making ability is recognized so that the two basic rights can be harmonized, the parent’s right to child care should be conceded to the child’s right to play.
