본 연구는 유럽연합 인권정책의 동향과 전략적 특징을 살펴보는 데 목적을 두고 있다. 이에 마스트리히트조약 발효(1993) 이후의 일반현황을 개관하였으며, 공동외교안보정책의 틀 속에서 인권정책의 수단․기제 및 도전․과제가 기술되었다. 또한 유럽연합 인권정책의 맥락에서 독일의 경우를 중심으로 하여 국가인권정책의 사례가 상술되었다. 본고에서 강조하고자 하는 사항은 다음과 같이 몇 가지 명제로 요약된다. 첫째, 유럽연합의 기반을 이루는 것은 자유․민주주의의 원칙, 인권․기본권 존중의 원칙 그리고 법치국가의 원칙이다. 동 원칙에 대한 신봉은 특히 마스트리히트조약(1993년 발효)에서 일차적 법(조약)의 수준에서 착근되었다. 둘째, 공동외교안보정책의 틀 내에서 EU인권정책의 특징은 정합성과 일관성을 갖춘 접근방안을 개발하는 데 중점을 두고 있다는 것이다. 셋째, 유럽연합은 포괄적이고 분화된 인권정책을 추구하고 있지만, 다른 한편으로는 인권전담기구가 아니라, 안보․경제․환경․이주정책과 같은 다른 이해관계를 갖고 있는 정치적 행위주체라는 점에 유의할 필요가 있다. 인권침해를 자행하는 국가에 대한 강력한 대외정책의 조치는 그 적용에 있어서 상당 부분 상위의 더 포괄적인 안보․경제정책의 목표에 의존하고 있다. 넷째, 독일 사례분석을 통한 국가인권정책과 관련하여, 독일은 대체로 EU 인권정책의 흐름에 부응하고 있지만, 적어도 인권적 접근방안에 비추어볼 때, 형식적․과정적․내용적 차원에서 부분적으로 개선의 여지가 있다는 점을 지적할 수 있다.
Abstract
The purpose of this paper is to share the results of a study that focused on human rights policy in the EU. In this context this article deals with the following themes: general trend and relevant facts about human rights policy in the EU after the Maastricht treaty (1993), in which the principle of respect for human rights was formally anchored on the level of the primary law (i.e. treaty document); human rights policy in the framework of the common foreign and security policy of the EU; and the state human rights policy exemplified by the German case. The bottom line of this paper can be formulated as follows. First, the principles of freedom and democracy, respect for human and basic rights, and rule of law constitute the basis of the EU. Second, the crucial point of human rights policy in the framework of the common foreign and security policy of the EU lies in developing coherent and consistent approaches. Third, although the EU pursues a comprehensive and differentiated human rights policy, it is necessary, on the other hand, to pay attention to the fact that the EU is not an organization in exclusive charge of human rights, but dependent also somewhat or, in lots of cases, more heavily on the interests of security, economy, environment, and migration policy. Fourth, regarding the example of national human rights policy, Germany tends to do justice to the stream of human rights policy of EU on the whole, but, it shows on the other hand some points or aspects of deficit in the three dimensions of polity, politics, and policy, at least in the light of the desirable human rights approach.
