과학수사 분야 국제표준 ISO 18385의 주요 내용과 정책적 함의
ISO 18385 Forensic Science’s Standardization and its Policy Implications

최근 ISO(국제표준화기구) 기술위원회 TC 272 Forensic Sciences에서 법과학 분야 표준 및 가이드라인을 순차적으로 발간하여, 범죄현장과 실험실에서 일반적 기술과 절차를 규정화시키는 작업을 진행 중이다. 이러한 과학수사 국제표준화의 흐름 속에서 우리나라의 과학수사 분야가 이러한 국제표준화에 부응하여 향후 과학수사 제반 절차에 대한 ISO 표준의 부합을 도모하고, 필요 시 적합성 평가를 통한 인증 획득으로 국제적 공신력 확보에 필요한 정보를 제공하기 위하여 ISO 18385 표준의 내용을 심층 분석하였다. ISO 18385:2016은 글로벌 법과학 커뮤니티가 사용하는 제품에서 검출 가능한 인간 핵 DNA 오염의 발생 리스크를 최소화하도록 제조업체의 요구사항을 지정하고 있다. 구체적으로 1장에서 적용범위를, 2장과 3장에서는 용어 정의 및 약어를, 4장에서는 DNA수사 목적의 감정물의 채취, 보관 및 분석을 위해 사용하는 면봉 등 법과학 용품(제품)의 유형을, 5장은 법과학 용품의 제조 및 제조환경 상의 품리관리시스템을, 6장과 7장은 위 법과학 용품의 수명주기 전반에 걸친 오염 리스크 관리와 인간 DNA 오명 방지를 위한 환경 모니터링을, 8장과 9장은 DNA 오염 방지를 위한 생산 후 처리(Post-Production Treatment)의 대상이 되는 법과학 용품과 대상이 아닌 용품에 대한 요구사항을 다루며, 마지막 10장에서는 제품의 포장, 라벨지 부착, 기록유지 등 문서화를 다루고 있다. 이 표준의 분석 결과가 시사하는 것은 무엇보다 이 국제표준의 내용과 우리나라 과학수사 관련 법규, 지침 등에 차이가 있는 부분들을 조속히 개정 반영하여 글로벌 표준에 부합하기 위한 노력이 필요하다는 점이다. 그리고 후행 연구를 통해 ISO 18385 인증을 위한 「인증 및 이행 가이드라인」을 개발하고 관련 분야 과학수사 종사자들에 대한 교육이 요구된다는 것이다. 아울러 인증 획득을 통해 KOICA 사업 등 치안한류 사업에서 한국의 과학수사 법규와 실무가 국제표준에 부합함을 선언 및 홍보하는 방향으로 이어나가야 할 것이다.
Abstract
Recently, the International Organization for Standardization (ISO) Technical Committee TC 272 Forensics Sciences has published standards and guidelines for the field of law in sequence, and is working to define general technologies and procedures at crime sites and laboratories. In this context, the main goal of Korea's scientific investigation field is to meet this international standardization to meet ISO standards for future scientific investigation procedures and secure international public confidence by obtaining certification through conformity assessment process. ISO 18385:2016 specifies manufacturers' requirements to minimize the risk of human DNA contamination detectable in products used by the global forensic science community. What the analysis results of this standard suggest is that efforts to meet global standards are needed to promptly revise and reflect differences in the contents of this international standard and laws and guidelines related to scientific investigations in Korea. In addition, through follow-up research, the "Certification and Implementation Guidelines" for ISO 18385 certification are developed, and education for scientific investigation workers in related fields is required. In addition, through obtaining certification, it is necessary to declare and promote that Korean scientific investigation laws and practices conform to international standards in Korean Wave projects such as KOICA projects.
